Overview: To authorize the Manager to execute deeds to allow for the transfer of Greene Tract property with the Town of Chapel Hill, Orange County, and the Town of Carrboro.

Recommendation(s): |
That the Council adopt the resolution authorizing the Town Manager to execute the Greene Tract deeds.
Key Points:
• On November 17, 2021, the Town Council adopted the Greene Tract Resolution <https://chapelhill.legistar.com/LegislationDetail.aspx?ID=5215731&GUID=A97A03E0-ACCB-45A5-9EBC-36ECCAFF5C23> approving the Draft Recombination Plat and Conceptual Plan. The resolution authorized the Manager to sign the final recombination plat.
• During the process of recording the recombination plat, it was determined that new property deeds executed by the three jurisdictions (Town of Chapel Hill, Town of Carrboro, and Orange County) also were needed to facilitate the property transfer as shown in the recombination plat.
• The new deeds have been reviewed by the Town Attorney’s office, the Town of Carrboro, and Orange County.
Next Steps:
• Once the deeds are executed, the recombination plat and deeds will be recorded.

A RESOLUTION AUTHORIZING TOWN MANAGER TO EXECUTE DEEDS FOR THE GREENE TRACT PROPERTY TRANSFER (2023-03-22/R-3)
WHEREAS, on November 17, 2021, the Council of the Town of Chapel Hill authorized the Manager to sign the final recombination plat for the Greene Tract on behalf of property owner Town of Chapel Hill; and
WHEREAS, staff subsequently determined that new property deeds between the three Greene Tract owners, the Town of Chapel Hill, the Town of Carrboro and Orange County, were needed prior to recording the final recombination plat; and
WHEREAS, the new deeds address the transfer of acreage from the Greene Tract’s jointly-owned parcel to the County-owned parcel and from the County-owned parcel to the jointly-owned parcel.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to execute the final deeds for the Greene Tract property transfer, together with any required supporting documentation, on behalf of property owner Town of Chapel Hill.
