Consideration of the Extraterritorial Jurisdiction (ETJ) Study Areas as Part of the Charting Our Future Project.

Overview: In June of 2018, community members requested the expansion of the Future Land Use Map Refinement Project, which is the first phase of the Charting Our Future Project, to include additional areas of Town.  Consideration of this expansion is currently before the Town Council.  Inclusion of these areas will require additional resources, including additional funds for consulting services as well as potentially diverting some staff resources from the existing portions of the Charting Our Future Project.

 

Recommendation(s):

That the Council adopt the resolution to:

                     Postpone consideration of the land use for the ETJ Study Area north of I-40;

                     Authorize the Town Manager to continue efforts to work with relevant governmental partners prior to planning and executing a visioning effort for the area south of Southern Village;

                     Authorize the Town Manager to include the cost of the visioning effort, both consultant and intern assistance, as well as some engineering costs in the budget proposals for FY2020; and,

                     Authorize the Town Manager to continue to pursue the existing process for the refinement of the Future Land Use Map (FLUM) with the possibility of amending the FLUM when the visioning effort for the ETJ Study Area is complete.

Key Issues:

                     Should visioning for the area north of I-40 be postponed?

                     Should the visioning effort for the Southern ETJ Study Area be delayed until after the Water and Sewer Management, Planning and Boundary Agreement (WASMPBA) is formally amended by all parties?  Or, should the visioning exercise take place after there is conceptual agreement by all parties to move the Urban Services Boundary?

                     Which part of the area south of Southern Village should be included in the visioning effort?  On the map entitled “Southern Orange County Planning Jurisdictions,” see the pink and dark pink areas south of Mount Carmel Church Road, west of Old Lystra Road to Smith Level Road.   

 

Fiscal Impact/Resources: The preliminary estimated expense for planning-related activities, which includes a visioning effort for the area south of Southern Village only, is approximately $75,000.  This estimate may change depending on the scope of the planning efforts in the ETJ Study Areas.  These funds would be in addition to the funds currently budgeted and anticipated for the Charting Our Future Project.  Engineering expense may also be necessary, and if Council concurs, staff will work with the Orange Water and Sewer Authority (OWASA) to obtain these costs.

A RESOLUTION CONSIDERING THE INCLUSION OF THE EXTRATERRITORIAL JURISDICTION STUDY AREAS AS PART OF THE CHARTING OUR FUTURE PROJECT (2019-01-30/R-5)

WHEREAS, in June of 2018, community members requested that the Town Council consider expanding the areas for consideration in the refinement of the Future Land Use Map, which is phase I of the Charting Our Future Project; and

WHEREAS, the Council asked the Town Manager to work with the affected governmental partners and to return to Council with options for incorporation of one or both of these Extraterritorial Jurisdiction (ETJ) Study Areas into the Charting Our Future Project; and,

WHEREAS, the Council met with the Orange County Commissioners in October of 2018 to discuss the possibility of reconsidering the future land uses for these ETJ Study Areas.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council:

                     Postpones consideration of the land use for the ETJ Study Area north of I-40;

                     Authorizes the Town Manager to continue efforts to work with relevant governmental partners prior to planning and executing a visioning effort for the area south of Southern Village;

                     Authorizes the Town Manager to include the cost of the visioning effort, both consultant and intern assistance, as well as some engineering costs in the budget proposals for FY2020; and,

                     Authorizes the Town Manager to continue to pursue the existing process for the refinement of the Future Land Use Map (FLUM) with the possibility of amending the FLUM when the visioning effort for the ETJ Study Area is complete.
