Overview: Council has expressed interest in revisions to the Land Use Management Ordinance (LUMO) to address the role of advisory boards in the review and approval of land use applications. This text amendment proposes that some or all Concept Plans would only be reviewed by Council, and that the Board of Adjustment (BOA) would review and approve certain types of Special Use Permits (SUP).


Recommendation(s):
That the Council adopt the resolution calling a legislative hearing to consider amending the Land Use Management Ordinance on November 15, 2023.

A RESOLUTION CALLING A LEGISLATIVE HEARING TO CONSIDER A LAND USE MANAGEMENT ORDINANCE TEXT AMENDMENT REGARDING UPDATES TO PROCEDURES FOR SPECIAL USE PERMITS AND CONCEPT PLANS AND RELATED TO ARTICLES 3, 4, AND 8 FOR NOVEMBER 15, 2023 (2023-10-11/R-5)

WHEREAS, at their September 20, 2023 work session, Town Council expressed interest in modifying existing procedures to better align with the Complete Community framework; and

WHEREAS, Town Council discussed the role of advisory boards and commissions in the review and approval of land use applications. This included allowing the Board of Adjustment to review and approve certain types of Special Use Permits (SUPs) and reconsidering which bodies review and provide comment on concept plans; and

WHEREAS, Land Use Management Ordinance Article 3 - Zoning Districts, Uses, and Dimensional Standards outlines which uses requires Special Use Permits; and
