Overview: Moriah Ridge, LLC is requesting that the Town of Chapel Hill collaborate with the City of Durham to amend the Consent Judgment between the two municipalities. The applicant is requesting annexation by the City of Durham so the project could be served by water and sewer.


Recommendation(s):
That the Council adopt a resolution directing the Manager and Town Attorney to collaborate with the City of Durham to revise the Consent Judgment.

Decision Points:
* The properties owned by Moriah Ridge, LLC are located within Chapel Hill's jurisdiction, within Orange County.
* The existing Consent Judgment limits the power of Chapel Hill to annex property located in Durham County and limits the power of Durham to annex property located in Orange County.
* The Consent Judgment would need to be amended to allow the annexation of the properties by the City of Durham.
* The property is located outside of the Water and Sewer Management Planning and Boundary Agreement (WASMPBA) and utility service from OWASA is not available.

Fiscal Impact/Resources: The applicant indicates utilities will be extended to adjacent Town-owned property. The applicant has committed to donating a portion of an adjacent parcel providing access to the Town-owned parcel to Erwin Road.
