Overview: The plan for the Weavers Grove Development includes a proposed realignment of Ginger Road. The realignment involves closing a portion of the existing public right-of-way (ROW) and dedicating new ROW.

North Carolina General Statute (NCGS) Sec. 160A-299 sets the process for closing public ROW, requiring the Council to adopt a resolution declaring its intent to close the public ROW and to call a public hearing.  The resolution will be published once a week for four successive weeks before the hearing.  A notice of the closing and public hearing will be posted in at least two places along the ROW.

 

Recommendation(s):

That the Council adopt the resolution to call a Public Hearing to consider closing a portion of the public ROW to support the realignment of Ginger Road within the Weavers Grove Development on January 11, 2023.

A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER A REQUEST TO CLOSE A PORTION OF PUBLIC RIGHT-OF-WAY ON GINGER ROAD WITHIN THE WEAVERS GROVE DEVELOPMENT ON JANUARY 11, 2023 (2022-11-16/R-8)

 

WHEREAS, the Town of Chapel Hill has received a request, from Ballentine Associates to close a portion of public right-of-way for a realignment of Ginger Road within the Weavers Grove Development; and

 

WHEREAS, the adjacent front property owners to the existing public ROW requested to be closed are six individual property owners within the Chandler’s Green Subdivision; and

 

WHEREAS, the Weavers Grove developer would like to divide the closed area between the Weavers Grove property and the Chandler’s Green Subdivision per NCGS 160A-299; and 

 

WHEREAS, the realignment of Ginger Road is in accordance with their development plan. 

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby declares its intent to consider closing the subject portion of Ginger Road public right-of-way.

 

BE IT FURTHER RESOLVED that the Council calls a Public Hearing at 7:00 p.m. on Wednesday, January 11, 2023 in the Town Hall Council Chamber, 405 Martin Luther King, Jr. Blvd. to receive public comment on the proposed closure of said right-of-way and hereby authorizes the Town Manager to arrange publication, posting, and mailing of notices of the Public Hearing as required by law. The Public Hearing will be closed and on January 11, 2023, the Council may take final action.
