Overview: Staff is developing proposed revisions to the Land Use Management Ordinance (LUMO) that respond to the interests of the September 22, 2021 petition <https://chapelhill.legistar.com/LegislationDetail.aspx?ID=5146393&GUID=0711EF32-5F1D-4D45-AECF-823F900B86DE> by Council members to create an expedited application process for projects with a substantial amount of affordable housing.

That the Council adopt the resolution calling for a legislative hearing on October 19, 2022to amend the Land Use Management Ordinance (LUMO) related to a community priority review process for affordable housing.
Key Issues:
• Timely review of applications for qualifying affordable housing projects that maximizes financing and funding opportunities.
• Reducing local barriers to entry for affordable housing developers, including “at-risk” investment.
• Expanding the suite of strategies that address escalating housing prices, scarcity of affordable units, and limited production of new housing.

A RESOLUTION CALLING A LEGISLATIVE HEARING TO CONSIDER A LAND USE MANAGEMENT ORDINANCE TEXT AMENDMENT TO ARTICLES 3, 4, AND 5 REGARDING A COMMUNITY PRIORITY REVIEW PROCESS FOR AFFORDABLE HOUSING APPLICATIONS FOR OCTOBER 19, 2022 (2022-09-14/R-10)
WHEREAS, on September 22, 2021, Council members petitioned the Town Council to implement strategies to rapidly promote increased production and availability of affordable and missing middle housing, with one component of the petition being an expedited application process for projects with a substantial amount of affordable housing; and
WHEREAS, on May 11, 2022, the Town Council held a Work Session to discuss potential solutions for expediting review and provided direction on the elements to incorporate into a new process for affordable housing applications; and
WHEREAS, Town staff has worked in consultation with stakeholders to formulate possible modifications to the Land Use Management Ordinance that respond to the petition interests; and
WHEREAS, the Planning Commission is scheduled to consider a Land Use Management Ordinance text amendment on this topic at an upcoming meeting and is scheduled to forward a recommendation to the Council before the legislative hearing.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Legislative Hearing on Wednesday, October 19, 2022, at 7:00 p.m. in the Council Chamber, Town Hall, 405 Martin Luther King, Jr. Blvd., for consideration of a Land Use Management Ordinance text amendment regarding a community priority review process for affordable housing applications.
BE IT FURTHER RESOLVED that the Council refers the proposed amendments to the Town Manager, Planning Commission, and Housing Advisory Board for their recommendation.
