Overview: North Carolina General Statute 160A-536 <https://www.ncleg.net/EnactedLegislation/Statutes/PDF/BySection/Chapter_160A/GS_160A-536.pdf> establishes requirements which municipalities must follow when deciding to contract with a private agency to provide services to a municipal service district (MSD). These include using a bid process to determine which agency is best suited to achieve the needs of the service district, entering into a contract not to exceed five years in length, and holding a public hearing prior to entering into a contract for services.
The Town’s current contract for services to the Downtown MSD has been in place since July 2016. The Town published a Request for Proposals <https://www.townofchapelhill.org/home/showpublisheddocument?id=48587> on April 1, 2021 for services during the fiscal year starting July 1, 2021. The submittal period closes at noon on Monday, April 19, 2021. The Council and the public will have a chance to review the proposals at a public hearing in May prior to awarding a contract in June.

That the Council adopt the resolution to call a Public Hearing for May 5, 2021 to consider proposals for providing services to the Downtown Municipal Service District.
Fiscal Impact/Resources: The current annual contract amount for these services is $210,376. Staff expects there will be about $220,000 available for this contract in Fiscal Year 2021-22, subject to budget approval.

A RESOLUTION TO CALL A PUBLIC HEARING FOR MAY 5, 2021 TO CONSIDER PROPOSALS FOR PROVIDING SERVICES TO THE DOWNTOWN MUNICIPAL SERVICE DISTRICT (2021-04-21/R-3)
WHEREAS, the Town of Chapel Hill desires to contract with another agency to provide services that promote, maintain, and enhance the Town’s Downtown Municipal Service District (MSD); and
WHEREAS, North Carolina General Statute 160A-536 establishes requirements that municipalities must follow when deciding to contract with another agency to provide services to a MSD; and
WHEREAS, the Town must hold a public hearing prior to entering into a contract with a private agency for MSD services.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby declares its intent to consider proposals for providing annual services to the Downtown Municipal Service District.
BE IT FURTHER RESOLVED that the Council calls a Public Hearing at 7:00 pm on Wednesday, May 5, 2021 in a virtual meeting to receive public comment on the proposals for providing services to the Downtown Municipal Service District and hereby authorizes the Town Manager to arrange publication and posting of notices of the Public Hearing as required by law.
