Approve the Miscellaneous Budget Ordinance Amendments to Adjust Various Fund Budgets for FY 2020-21.

Overview: After the Council adopts the annual budget, periodic changes require the Town to amend the current budget.

 

Recommendation(s):

That the Council:

                     Enact the attached budget ordinance amendment to adjust the General Fund, Capital Improvements Fund, Grants Fund, Transit Fund, Transit Capital Reserve Fund, Public Housing Fund, and the Library Gift Fund; and

                     Enact the attached project ordinance amendments to adjust the Affordable Housing Fund, Housing Capital Grants Fund, Capital Projects Ordinance Fund, and the Transit Capital Grants Fund; and

                     Adopt the attached resolutions to accept the Alcohol Beverage Control (ABC) Grant, Stonyfield Grant, Public Housing CARES Act Grant, Institute of Museum and Library Services (IMLS) CARES Act Grant, Governor’s Highway Safety Grant, Orange County Arts Commission Grant, NC Department of Environmental Quality (NCDEQ) Grant, Section 5310 Grant, and Congestion Mitigation and Air Quality (CMAQ) Grant.

 

Key Issues:

                     General Fund

On June 15, 2020, the Town received a $5,000 grant from Stonyfield Farm.  The grant funds will be used to pilot organic landscaping treatments and practices in a limited area of a Town park.  Treatments may include soil testing, organic fertilizer and other soil amendments, and organic weed control products. The Town will use information from the pilot to inform future maintenance practices and/or recommendations.  Adopting the resolution authorizes acceptance of the Stonyfield grant and enacting the attached budget ordinance amendment recognizes and appropriates the grant funds.

 

                     Capital Improvements Fund

On September 3, 2019, the Town received $9,500 in payment in lieu of recreation space for the Park Apartments project.  These funds will be used to complete work at Burlington Park.  Enacting the attached budget ordinance amendment transfers $9,500 from the Capital Projects Ordinance Fund to the Capital Improvements Fund to complete the project. 

 

                     Grants Fund

Alcohol Beverage Control (ABC) Board Grant - The Orange County ABC Board awarded the Town of Chapel Hill $28,000 to continue supporting the Police Department’s alcohol law enforcement efforts.  These funds will be used for off-duty salaries and benefits for specialized training as well as supplies and materials for those operations. There are no matching requirements for this grant.  Adopting the resolution authorizes acceptance of the ABC Grant, and enacting the budget ordinance amendment establishes the grant budget of $28,000.

 

Governor’s Highway Safety Program Grant - The Town received a grant from the Governor’s Highway Safety Program to work on pedestrian safety initiatives outlined in the Pedestrian Safety Action Plan, which was completed in 2019. The grant includes $19,000 for a program support position, the GIS/Complete Streets Specialist, whose primary responsibility will be to implement the recommendations from the Pedestrian Safety Action Plan. This includes creating an inter-agency pedestrian safety task force, classifying the Town’s roads by crash risk, and conducting outreach and education around pedestrian safety.  The grant also includes $35,000 for high-visibility pedestrian safety activities. Finally, the grant includes $13,000 for operating expenses related to the project.  Adopting the resolution authorizes acceptance of the Governor’s Highway Safety Grant, and enacting the budget ordinance amendment establishes the grant budget of $67,000.

 

                     Transit Fund

Congestion Mitigation and Air Quality (CMAQ) Grant - This grant is funded through CMAQ Flex through the North Carolina Department of Transportation to fund new transit services, specifically Sunday service. Federal share of this project is $641,930 (80%) with a local match of $160,484 (20%), which will come from existing funding in the Transit Fund.  Adopting the resolution authorizes acceptance of the CMAQ Grant and enacting the budget ordinance amendment recognizes and appropriates the grant budget of $802,414 in the Transit Fund.

 

Section 5310 Enhanced Mobility of Seniors and Individual with Disabilities Grant - The Town of Chapel Hill was awarded $131,760 by the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization (MPO) to continue our Senior Shuttle service.  An additional $20,275 was awarded to review existing bus stops in Carrboro and Chapel Hill for compliance with the Americans with Disabilities Act (ADA).  These funds will require a local match of $152,035 (50%), which will come from existing funding in the Transit Fund.  Adopting the resolution authorizes acceptance of the Section 5310 Grant, and enacting the budget ordinance amendment recognizes and appropriates the grant budget of $304,070.

 

CARES Act Section 5307 Funding for Operations - The Town of Chapel Hill Transit system was awarded $5,736,790 in CARES Act funding to help respond to and recover from the COVID-19 pandemic.  The funds are intended for Fixed Route operational assistance and ADA Paratransit operating expenses, including operator and administrative salaries, cleaning and sanitation supplies required in response to the pandemic and fuel costs. 

 

The NCDOT removed the State Maintenance Assistance Program (SMAP) funds from their current budget as a result of budgetary constraints.  The FY 2020-21 Transit budget included $2,629,698 in SMAP funds that needs to be unrecognized.  The CARES Act funds will be used to pay for operating expenditures (Transit salaries, benefits, fuel, cleaning supplies, etc.) to keep the system running.  These funds will free up currently budgeted Transit expenditures to be set aside for future Transit system needs.  Enacting the budget ordinance amendment recognizes the CARES Act funds, unrecognizes the SMAP funds, and establishes the contribution to reserve.

 

                     Public Housing Fund

On March 27, 2020 the Coronavirus Aid, Relief, and Economic Security (CARES) Act was signed into law and provided flexibilities and waiver authority for Housing and Urban Development (HUD) to help Public Housing Agencies respond to the COVID-19 pandemic.  The Town of Chapel Hill has a total of $162,170 in supplemental funds available for various public housing expenses related to preparing, preventing, and responding to the COVID-19 pandemic.  Enacting the budget ordinance amendment recognizes and appropriates the $162,170 in CARES funds in the Public Housing Fund.

 

                     Library Gift Fund

Institute of Museum and Library Services (IMLS) CARES Act Grant - The Town of Chapel Hill has been awarded an IMLS CARES Act grant in the amount of $149,435 to expand technology access in Chapel Hill.  The project, "Whenever, Wherever, Whyever: Expanding Technology Access," will address the community's ongoing need for public computing services and the challenges of providing these services during a pandemic.  This initiative will focus on patrons who do not have sufficient computer and internet access at home, including job seekers, low-income residents, and historically marginalized populations.  Enacting the budget ordinance amendment recognizes and appropriates the $149,435 in CARES funds to the Library Gift Fund. 

 

Orange County Arts Commission (OCAC) Grant - The Orange County Arts Commission has awarded the Town of Chapel Hill $1,339 to support the creation of a new “NAACP Youth Council Art Bus.” This new “Art Bus” will focus on themes of racism, anti-racism, and racial justice, and will include an exterior vinyl wrap and an interior ceiling installation on a Chapel Hill Transit bus.  Adopting the resolution authorizes acceptance of the OCAC grant, and enacting the budget ordinance amendment recognizes and appropriates the grant budget of $1,339 in the Library Gift Fund.

 

                     Affordable Housing Fund

The Town has received $18,460 from community donations for the Emergency Housing Assistance Program.  Enacting the project ordinance amendment recognizes the community donations of $18,460 and appropriates the funds to provide support to town residents experiencing a housing crisis.

 

                     Housing Capital Grants Fund

On September 5, 2018 HUD awarded the Town $782,242 for building improvements for projects identified in the Public Housing Master Plan.  An additional $7,076 has been added by HUD to the 2018 Capital Grant and will be used for further building improvements in the Oakwood neighborhood.  Enacting the budget ordinance amendment recognizes and appropriates the budget of $7,076 in the Housing Capital Grants Fund.

 

                     Transit Capital Grants Fund

NC Department of Environmental Quality (DEQ) Volkswagen (VW) Grant for Electric Buses - The NC DEQ awarded the Town of Chapel Hill $485,000 to cover the difference in cost between a traditional diesel bus and a Gillig Battery Electric Bus (BEB) and associated charging infrastructure. The Town’s match for the grant of $450,000 (for the bus) and $15,000 (for the charging station) will be provided from Chapel Hill Transit’s Capital Reserve Fund.  NC DEQ will provide $400,000 for the bus and $85,000 for the charging station.  Adopting the resolution authorizes acceptance of the NC DEQ funds, and enacting the budget ordinance amendment recognizes and appropriates the budget of $950,000 in the Transit Capital Grants Fund and transfers $465,000 from the Transit Capital Reserve Fund for the local match.

WHEREAS, the NCDOT has awarded funds for a total amount of $641,930; and

 

WHEREAS, the funds would be used to provide Sunday services.

WHEREAS, the NC Department of Environmental Quality has awarded funds for a total amount of $485,000; and

 

WHEREAS, the funds would be used to cover the difference in cost between a traditional diesel bus and an electric bus and associated charging infrastructure.

BE IT ORDAINED by the Council of the Town of Chapel Hill that, pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the Affordable Housing Fund Ordinance to provide funds to support affordable homeownership opportunities is hereby amended as follows:

 

“SECTION I

 

The Affordable Housing Fund Ordinance as authorized by the Town Council provides funds to purchase properties to create permanently affordable homeownership opportunities.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.

 

 

SECTION III

 

Revenues anticipated to be available to the Town are hereby amended as follows:

 

 

SECTION IV

 

Amounts appropriated to create permanently affordable homeownership opportunities are hereby amended as follows:

 

 

SECTION V

 

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.

 

 

SECTION VI

 

Copies of this amended projects ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Business Management Director and Town Clerk.”

AN ORDINANCE TO AMEND A CAPITAL FUND PROGRAM (CFP) PROJECT ORDINANCE (2020-10-28/O-3)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following project ordinance is hereby amended as follows:

 

“SECTION I

 

The project authorized is the Housing Capital Fund Project budget as approved by the Council on September 5, 2018.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation with the project within the terms of the Contract document(s), the rules and regulations of the U.S. Department of Housing and Urban Development, and budget contained herein.

 

 

SECTION III

 

The following revenue is available to complete the project:

 

 

SECTION IV

 

The amounts appropriated for the project are amended as follows:

 

 

 

 

SECTION V

 

The Finance Officer of the Town of Chapel Hill is hereby directed to maintain within the Project Fund sufficient specific detailed accounting records to provide the accounting to the U.S. Department of Housing and Urban Development as required by the Annual Contributions Contract and federal regulations.

 

SECTION VI

 

Funds may be advanced from General funds for the purpose of making payments as due.  Reimbursement requests should be made to HUD in an orderly and timely manner.

 

 

SECTION VII

 

The Manager is directed to report annually on the financial status of each project in Section IV and on the total revenues received.”

AN ORDINANCE TO AMEND THE CAPITAL PROJECT ORDINANCE FOR VARIOUS CAPITAL PROJECTS (2020-10-28/O-4)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the capital project ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:

 

“SECTION I

 

The capital projects as authorized by the Town Council include various capital projects funded from grants, the Capital Improvements Program funds, and other miscellaneous sources of revenues for a variety of projects extending beyond one year.

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

 

 

SECTION IV

 

Amounts appropriated for capital projects are hereby amended as follows:

 

 

SECTION V

 

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.

 

SECTION VI

 

Copies of this amended projects ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Business Management Director and Town Clerk.”

AN ORDINANCE TO AMEND A TRANSIT CAPITAL PROJECT ORDINANCE (2020-10-28/O-5)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the transit capital projects ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:

 

“SECTION I

 

Transit capital projects as authorized by the Town Council are capital projects funded from Federal Transit Administration (FTA) grants and grants from the State of North Carolina.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these transit capital projects within terms of funds appropriated here.

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

 

 

SECTION IV

 

Amounts appropriated for capital projects are hereby amended as follows:

 

 

SECTION V

Funds may be advanced from General funds for the purpose of making payments as due.  Reimbursement requests should be made to FTA in an orderly and timely manner.

By enacting the budget ordinance amendment, the Council adjusts the General Fund, Capital Improvements Fund, Grants Fund, Transit Fund, Public Housing Fund, Library Gift Fund and Transit Capital Reserve Fund FY 2021 budgets.  By enacting the project ordinance amendments, the Council adjusts the Affordable Housing Fund, Housing Capital Grants Fund, Capital Projects Ordinance Fund, and the Transit Capital Grants Fund project budgets.  By adopting the resolution, the Council accepts funding from Stonyfield Farm, the Orange County ABC Board, Governor’s Highway Safety Program, NC Department of Transportation, the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization (MPO), CARES Act, Institute of Museum and Library Services CARES Act, Orange County Arts Commission, and NC Department of Environmental Quality.
