Overview: The proposed text amendments to the Code of Ordinances that regulate Parks and Greenways, Sidewalk Sales, and Bicycling will bring them in accordance with current State statutes and operating procedures, and allow the Town to pursue shared transportation programs such as bikeshare.
Recommendation(s):
That the Council enact Ordinances A, B, and C revising Town Codes 12-3(d), 17-76 through 17-90, and 21-41 through 21-62.
Key Issues:
* The Town is negotiating a contract to implement a one-year pilot bikeshare program consisting solely of electric-assist bicycles (e-bikes). This negotiation is in collaboration with the Town of Carrboro and with input from the University of North Carolina at Chapel Hill.
* Text amendments are required to update Chapters 12, 17, and 21 to clarify use of e-bikes on Town greenways, allow signage and rental of shared transportation vehicles in the public right-of-way with proper permits, bring the language into accordance with State statute, and reflect current operating procedures.
* Ordinance A amends Chapter 12 Section 3(d) rules and regulations for Town parks and greenways to clarify use of e-bikes on Town greenways.
* The Town's greenways serve as key connections and destinations for non-vehicular travel.
* Ordinance B amends Chapter 17 to allow shared transportation companies to apply for a permit to utilize the public right-of-way for advertisement, vehicle placement, or other uses. Chapter 17 currently prohibits use of public right-of-way for advertisement, sale, or rental of items.
* A successful shared transportation program must be able to place shared vehicles in public spaces for public use.
