Overview: Article IV, Campaign Disclosure and Contribution Limitations, of Chapter 2, Administration, of the Town Code of Ordinances needs to be updated to be consistent with revisions to State law.

 

Recommendation(s):

That the Council enact an ordinance updating Section 2-72 of the Town Code of Ordinances.

 

Key Issues:

                     In 2017, North Carolina General Assembly Session Law 2017-6 revised the State’s election laws.

                     The updated State law changes the statutory reference for exemptions from the campaign contribution limits.

                     The updated State law also changes which contributions are exempted from the contribution limits. Under the prior law, contributions from a candidate and a candidate’s spouse, parents and siblings were not restricted. Under the new law, applied by reference in Section 2-72 of the Town Code, contributions from parents and siblings of a candidate are now subject to the monetary limit.
