Recommendation(s):

That the Council make appointments to the Board of Adjustment for two Town seats. The Council may also make a recommendation to the Orange County Board of Commissioners for the two County seats.

 

Modified Appointment Process

Despite multiple recruitment efforts, the County has not received any applications from residents within Chapel Hill’s Extraterritorial Jurisdiction or within the Joint Planning Area. Per the Joint Planning Agreement, the positions may be filled with Town residents.

 

We propose a modified appointment process where the Council would select up to four Town residents.  If the Council agrees with the Board of Adjustment’s recommendation, then Thomas Wortman would fill the County Resident seat, Ian Morse would fill the County Alternate seat, and Thomas Grasty and Enton Hito would fill the Town Alternate seats.

 

Otherwise, we recommend a process of using alphabetical order by applicant’s last name; the Council would fill the two Town positions and adopt a resolution transmitting a recommendation to the County Commissioners for the two County positions.

A RESOLUTION MAKING A RECOMMENDATION TO THE ORANGE COUNTY BOARD OF COMMISSIONERS REGARDING THE ETJ/JPA SEATS ON THE CHAPEL HILL BOARD OF ADJUSTMENT (2019-10-02/R-11)

 

WHEREAS, the Orange County Board of Commissioners has a resolution regarding the Orange County Appointment and Orientation Process for Boards and Commissions that specifies “… When a vacancy exists, the municipality will be requested to provide to the Board of County Commissioners a resolution with a recommendation for that vacancy;” and

 

WHEREAS, despite multiple recruitment efforts, the County has not received any applications from residents within Chapel Hill’s Extraterritorial Jurisdiction or within the Joint Planning Area. Per the Joint Planning Agreement, the positions may be filled with Town residents; and

 

WHEREAS, the Chapel Hill Board of Adjustment has reviewed the viable applications and made a recommendation to the Chapel Hill Town Council.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council recommends the Orange County Board of Commissioners appoint ____________________________ to the County Resident ETJ position and ____________________________ to the County Alternate ETJ/JPA position on the Chapel Hill Board of Adjustment.

Recommendation:  The Board of Adjustment met on Thursday, September 12, 2019 and by a unanimous vote have made the following recommendations to the Town Council for consideration:

 

                     Thomas Wortman, Appointment, Resident seat

                     Thomas Grasty, Appointment, Alternate seat

                     Enton Hito, Appointment, Alternate seat

                     Ian Morse, Appointment, Alternate seat

 

Special Request(s): The Board would like all seats to be filled to elevate challenges created by the prolonged vacancies and intermittent absences.

Note: Communications and Public Affairs notes that the Board of Adjustment reviewed the following applications: Thomas P. Grasty, Enton P. Hito, Ian M. Morse, Adejuwon O. Ojebuoboh, and Thomas I. Wortman. Staff received one additional application from Michael Murphy between September 12, 2019 and September 25, 2019 for the Board of Adjustment. Mr. Murphy is a Town Resident. The Town and Joint Planning Area bisect his property.
