Overview: A text amendment to the Town Code that regulates sidewalk dining will increase flexibility for restaurants, include clarification on the permitting process, and comply with State statutes approved since the Code was written.

Recommendation(s):
That the Council enact the ordinance revising Town Code Sections 17-76 through 17-90 regarding sidewalk dining.

Key Issues:
* The Downtown Work Plan calls for the Town to foster variety and vibrancy in the public realm and remove regulatory barriers that impede variety and vibrancy.
* In 1995, the Town added sidewalk dining regulations to the Town Code that set limitations on where and how restaurants can place dining furnishings in the public right-of-way.
* In 2013, the General Assembly passed legislation about sidewalk dining that is required to be incorporated into the Town Code to ensure compliance.
* Both staff and restaurant owners have found that the current Code language lacks clarity on the permit application process and when revisions to permit applications are required.
* The proposed amendments to the Town Code are intended to increase flexibility for restaurants, clarify the application process and comply with State statutes.
* The proposed amendment was piloted over a year and feedback from that pilot was incorporated into the proposed amendment.
* All current sidewalk dining in the Downtown is compliant with the proposed amendment standards.

Fiscal Impact/Resources: None.
