Overview: The Town’s Homestead Road Sidewalk Project includes construction of 10’ wide sidewalks and bike lanes on both sides of the road between the intersections with Seawell School Road and Weaver Dairy Road Extension.  Approval of the attached Municipal Agreement with the North Carolina Department of Transportation (NCDOT) will make available up to $1,040,000 of federal Surface Transportation Block Grant Direct Attributable (STBGDA) funds for reimbursement to the Town for project construction.

 

Recommendation(s):

That the Council adopt a resolution authorizing the Town Manager to enter into a Municipal Agreement with NC Department of Transportation (NCDOT) and enact the attached project ordinance amendment to accept the federal STBGDA funds for construction of the Homestead Road Sidewalk Project.  

Key Issues:

                     On October 10, 2016, the Town Council authorized the Town Manager to proceed with design and construction of several high priority sidewalk projects <https://chapelhill.granicus.com/MetaViewer.php?view_id=21&clip_id=2925&meta_id=143008>, including the Homestead Road Sidewalk Project.

                     Town staff, along with the Town’s consultant (Kimley Horn and Associates) have developed 90% design plans. 

                     Recently, the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization (DCHC MPO) approved the use of up to $1,040,000 in federal funds from NCDOT for the Homestead Road sidewalk project construction.

                     Pending approval of the Municipal Agreement with NCDOT, Kimley Horn will complete 100% design plans and NCDOT will complete the required project review.

                     When NCDOT’s review is complete, the Town will request construction bids and return to Council to approve the construction contract award. Construction is tentatively planned to begin in Summer 2019.

 

Fiscal Impact/Resources: The Municipal Agreement allows up to $1,040,000 in construction costs for reimbursement to the Town for this project. 2015 Streets and Sidewalks bond funds have already been set aside for this project. Accepting the federal funding will free up a portion of the bond funds to be used toward other high priority planned Streets and Sidewalks projects; the remaining portion of the bond funds will cover the required 20% local match.

 

The attached project ordinance amendment will allow the Town to accept the federal funds from NCDOT.

A RESOLUTION AUTHORIZING THE TOWN MANAGER TO ENTER INTO A MUNICIPAL AGREEMENT WITH NORTH CAROLINA DEPARTMENT OF TRANSPORTATION (NCDOT) FOR REIMBURSEMENT OF THE CONSTRUCTION COSTS OF SIDEWALKS AND BIKE LANES ON HOMESTEAD ROAD AND TO AUTHORIZE ACCEPTANCE OF FEDERAL FUNDS FOR THIS PROJECT (2019-01-30/R-2)

 

WHEREAS, on October 10, 2016 the Town Council approved the Homestead Road Sidewalk Project, including design and construction of sidewalks and bike lanes on Homestead Road; and

 

WHEREAS, the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization and the North Carolina Department of Transportation have allocated Surface Transportation Block Grant Direct Attributable (STBGDA) funding for construction of the Homestead Road Sidewalk Project; and

 

WHEREAS, the North Carolina Department of Transportation agreed to reimburse the Town up to $1,040,000 for construction of the subject project; and

 

WHEREAS 2015 Streets and Sidewalks bond funds will cover the required 20% local match; and

 

WHEREAS, in order to receive the reimbursement, the Town of Chapel Hill and the North Carolina Department of Transportation must enter into a Municipal Agreement.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to enter into a Municipal Agreement with North Carolina Department of Transportation for construction of the Homestead Road Sidewalk Project.

 

BE IT FURTHER RESOLVED that the Council authorizes the Town Manager to accept the STBGDA funds for this project.

AN ORDINANCE TO AMEND THE 2015 STREETS AND SIDEWALKS BOND FUND FOR CAPITAL IMPROVEMENT PROJECTS (2019-01-30/O-1)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the following capital project is hereby amended for Streets and Sidewalk Improvements funded from 2015 General Obligation bonds approved by the voters in November 2015:

 

“SECTION I

 

The capital projects as authorized by bond referenda approved in November 2015, and as determined by the Town Council, includes streets and sidewalks capital improvements extending beyond one year.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.

 

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are as follows:

Amounts appropriated for capital projects are as follows:

 

 

SECTION V

 

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.

Copies of this amended projects ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Business Management Director and Town Clerk.”
