Department:

Ralph D. Karpinos, Town Attorney

Town Attorney’s Office

Overview: Adoption of the attached resolution would establish the Town Council’s position on proposed local and statewide legislative initiatives which have been identified as of interest to the Council.  If adopted, the resolution would be forwarded to the members of the North Carolina General Assembly whose legislative districts encompass some part of the Town’s corporate limits.

On February 28, 2018, the Council held a public forum on the budget and related matters. At that forum the two proposed local bills identified below were mentioned.  No public comment was received on either.

The Council met with the local Legislative Delegation on April 3, 2018, to discuss potential legislation of local and statewide interest.  As a result of that conversation, the attached resolution has been drafted to include the following legislative requests:

1.                     A request for a local bill to permit the Town to forego newspaper publication of public hearing notices.  This request would be for legislation similar to that granted to other local governments over the past several years.

2.                     A request for a local bill to expand investment options for funds accumulated to pre-fund post-employment benefit contributions.

3.                     Support for statewide legislation which might be proposed which would enhance the opportunities for citizens to voluntarily surrender firearms to local law enforcement and allow local law enforcement to destroy the firearms.

As other issues arise during the course of the upcoming session of the General Assembly, the Council may adopt further resolutions establishing its position to share with state elected officials.

Recommendation(s):

That the Council modify the proposed resolution as it deems appropriate and adopt it for forwarding to local members of the General Assembly.

Key Issues:

Does the proposed resolution accurately reflect the interests of the Council?

Are there other issues pending before the General Assembly which the Council wishes to comment on at this time?

Where is this item in its process?

The General Assembly is scheduled to convene May 16, 2018 for this year’s short session.  Requests for local bills should be submitted by May 24 and need to be filed for introduction by June 7.  After the Council adopts the Town’s Legislative Program, drafts of any proposed local legislation would be prepared and forwarded, along with the Council’s resolution, to members of the local delegation.

Council Goals:

Create a Place for Everyone

Develop Good Places,  New Spaces

Support  Community Prosperity

Nurture Our Community

Facilitate Getting Around

Grow Town  and Gown Collaboration

WHEREAS, the Council of the Town of Chapel Hill conducted a public forum on February 28, 2018, identified two potential items for possible local legislation; and

WHEREAS, the Council met with Senators Valerie Foushee and Mike Woodard and Representatives Verla Insko and Marcia Morey on April 3, 3018 to consider matters of local and statewide interest; and

WHEREAS, the Council has considered the comments in input from members of the Legislative Delegation and has afforded the public an opportunity to weigh in on local legislative initiatives.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby establishes the following as its Legislative Program for consideration in the 2018 Session of the General Assembly:

Local Issues

1.                     A bill to permit the Town to forego newspaper publication of public hearing notices.  This request would be for legislation similar to that granted to other local governments over the past several years.

2.                     A bill to expand investment options for funds accumulated to pre-fund post-employment benefit contributions.  This request would be for legislation similar to that granted to other local governments over the past few years.

Statewide Issues

1.                     Support for statewide legislation which might be proposed which would enhance the opportunities for citizens to voluntary surrender firearms to local law enforcement and allow local law enforcement to destroy the firearms.

BE IT FURTHER RESOLVED that the Council indicates its general support for the 2017-18 Advocacy Goals of the North Carolina League of Municipalities and for the 2018 Legislative Agenda of the North Carolina Metropolitan Mayors Coalition, while acknowledging that as specific issues come up the Council may choose to take further action to adopt a position not fully consistent with the views of either the League or the Coalition.

BE IT FURTHER RESOLVED that a copy of this Resolution, together with drafts of proposed local legislation on the two issues identified above, shall be forwarded to Senators Valerie Foushee and Mike Woodard and Representatives Verla Insko, Graig Meyer and Marcia Morey.
