LEGISLATIVE CONTEXT*

Development regulations adopted under the Town’s planning and zoning authority must be adopted by ordinance. N.C. Gen. Stat. § 160D-601.

Prior to any formal action, Council has requested opportunities to have high-level policy discussions regarding the updated LUMO.

BACKGROUND AND CONTEXT*

The Town is rewriting its Land Use Management Ordinance (LUMO) for the first time in over 20 years. This will be the ninth Council meeting regarding the updated LUMO since October 2023.

The main topics for discussion at this Council Work Session are (1) affordable housing incentives and (2) an equity analysis and recommendations for the updated LUMO.

COMPLETE COMMUNITY CONNECTION

The LUMO Update is an opportunity to implement various elements of the Town’s Comprehensive Plan, with the Complete Community Strategy at the forefront. The recommendations included in the attached memo will help the Town secure more affordable housing and adopt more equitable planning and zoning procedures.

DIVERSITY, EQUITY, INCLUSION

Staff are continuing to analyze the current LUMO through an equity lens based on the framework established in the American Planning Association’s Equity in Zoning Policy Guide. Prior analysis presented to Council focused on general planning and zoning rules. The attached report builds on this prior analysis by focusing on the procedures related to the Town’s land use rules.
