STAFF RECOMMENDATION*
Staff recommends that Council enact an ordinance and a resolution to amend the 2002 ordinance establishing the percent for art program for town funded capital improvement projects and its associated policies and procedures.

Town Charter Chapter III, Sec. 3.5(b) allows the governing body to “adopt and provide for the execution of such ordinances, rules, and regulations, not inconsistent with this Charter… “
BACKGROUND AND CONTEXT*
The Town Council created the Percent for Public Art Program in 2002. Since then, the Chapel Hill Public Arts Commission was disbanded, and the Town wishes to clarify and update the guidelines for the Percent for Art program. This is also an opportunity to update the "Percent for Art" language for consistency in all other TOCH language (including PFA Resolution) and broadly throughout the public art field to mean public projects, as opposed to "Public Art in Private Development".
