STAFF RECOMMENDATION

Staff finds that the project, subject to the stipulations in Resolution A, can comply with all regulations of the Land Use Management Ordinance. The Town recommends Council evaluate the requested special use permit under the applicable Finding(s) of Fact.

PROCEDURAL CONTEXT

The applicant’s proposal to increase floor area is a major modification to the existing permit. The Land Use Management Ordinance (LUMO), Town Code Appendix A Section 4.5.4 requires major modifications to a Special Use Permit to be approved by the original decision-making body, in this case Council.

BACKGROUND AND CONTEXT

This site is located within the University of North Carolina (UNC) Chewning Tennis Facility and must follow the requirements of that original Special Use Permit. Town Council approved a Special Use Permit (SUP) for this site in 1990. This modification request includes a new, two-story structure, increases the total permitted floor area, and clarifies the allowed use to align with current LUMO definitions.

COMMUNITY ENGAGEMENT

Staff have provided mailed notice to neighbors and other notifications according to LUMO requirements. Staff have not received significant numbers of phone calls or emails regarding the project.
