Overview: A text amendment to the Town Code that regulates sidewalk dining is proposed to increase flexibility for restaurants, include clarification on the permitting process, and comply with State statutes approved since the Code was written.

Recommendation(s): |
Provide comments to the Council on a text amendment to Town Code Sections 17-76 through 17-90 regarding sidewalk dining.
Key Issues:
• The Downtown Work Plan calls for the Town to foster variety and vibrancy in the public realm and remove regulatory barriers that impede variety and vibrancy.
• Current sidewalk dining regulations set forth in the Town code set limitations on where and how restaurants can place dining furnishings in the public right of way.
• The General Assembly passed legislation in 2013 that must be incorporated into the Town’s ordinances to ensure compliance.
• The current Code lacks clarification on the permit application process and when revisions to permit applications are required.
• The proposed amendment to the Town Code are intended to increase flexibility for restaurants, clarify the application process and comply with State statutes.
