Overview: North Carolina General Statute 163-294.2(e) states that the governing board shall set the filing fee for elections between $5.00 and less than one percent of the annual salary of the office sought.
Recommendation(s):
That the Council enact the ordinance to amend the Town Code of Ordinances to set the filing fees for election.

AN ORDINANCE TO AMEND ARTICLE I, CHAPTER 2, CODE OF ORDINANCES RELATED TO FILING FEES FOR ELECTION (2023-01-25/O-1)
WHEREAS, originally Chapel Hill had no filing fee; and
WHEREAS, in 1971, the General Assembly set the filing fees according to the Town population, with Chapel Hill fee set at a minimum of $25; and
WHEREAS, in 1974, North Carolina General Statute 163-294.2(e) establishes that the governing board shall set the filing fee for elections between $5.00 and less than one percent of the annual salary of the office sought; and
WHEREAS, the Council last set this fee on March 25, 1974 at the lowest amount allowed by statute; and
WHEREAS, several decades have passed since the fee was last set, and Council deems it prudent to set the fee at an amount more appropriate to the present day.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill that section 2-2.1 of the Code of Ordinances, Town of Chapel Hill, North Carolina, is hereby amended to read as follows:
"Sec. 2-2.1. - Filing fees for election.
Filing fees for election to town office shall be as follows:
Council .....$ 25.00
Mayor .....150.00"
