Overview: The Council Committee on Boards and Commissions has recommendations to refine some seat categories on several boards and amendments to the advisory board membership policy.

 

Recommendation(s):

That the Council adopt the attached resolution to authorize the Town Manager to act on the Council Committee on Boards and Commissions recommendations and call a public hearing to amend the Land Use Management Ordinance (LUMO).

 

Summary of Potential Amendments: For Council approval of the recommendations, a two-step process is necessary to make amendments regarding length of term, and board member attendance for the Board of Adjustment and Historic District Commission, which includes a public hearing to amend the LUMO.  For this reason, approval of the remaining changes would occur in the second step to make the changes effective at the same time for all advisory boards.

 

During the second step, amendment to the advisory board membership policy and Chapters 2, 6, 12, and 23 of the Code of Ordinances would adjust the length of term, and board member attendance for the remaining advisory boards.

 

In addition, during the second step, amendment to the advisory board membership policy would adjust seats on the Parks, Greenways and Recreation Commission, Environmental Stewardship Advisory Board, and Community Design Commission.

A RESOLUTION TO AUTHORIZE THE TOWN MANAGER TO ACT ON THE COUNCIL COMMITTEE ON BOARDS AND COMMISSIONS RECOMMENDATIONS AND TO CALL A PUBLIC HEARING TO AMEND THE LAND USE MANAGEMENT ORDINANCE (2018-10-17/R-3)

 

WHEREAS, the Council Committee on Boards and Commissions met on September 20, 2018 to consider information regarding advisory board alignment, length of term, board member attendance, and the Historic District resident seat on the Community Design Commission; and

 

WHEREAS, the Council Committee on Boards and Commissions recommends adding a stormwater seat on the Environmental Stewardship Advisory Board (ESAB) to recognize the stormwater interests in the review of development applications and evaluate that interest through the winter and consider the ESAB and SMUAB board alignment prior to the spring appointment cycle.

 

WHEREAS, the Council Committee recommends the creation of a cemeteries champion seat on the Parks, Greenways, and Recreation Commission to focus on cemetery beautification, and scatter garden interests by utilizing one of the vacant seats. In addition, the Committee recommends that the Council consider concluding the Cemeteries Advisory Board effective June 30, 2019, so that they may finish any existing projects; and

 

WHEREAS, the Council Committee recommends amending the length of term clause to remove the succession of members for positions where a replacement has not been made; and

 

WHEREAS, the Council Committee recommends amending the attendance clause to recognize that any member of the board, commission or committee who misses more than three (3) consecutive regular meetings or more than half the regular meetings in a calendar year shall lose his or her status as a member of the board, commission or committee, and shall be replaced by the Council or Orange County Board of Commissioners, as appropriate.

 

WHEREAS, the Council Committee recommends dissolving the Chapel Hill Historic District Resident designation on the Community Design Commission and adding “green design” to the list of “demonstrated special training or experience” described in the seat requirements in the advisory board policy.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to act on the Council Committee on Boards and Commissions recommendations, by preparing an item to amend the advisory board membership policy and relevant sections of the Code of Ordinances to:

                     add a stormwater seat on the Environmental Stewardship Advisory Board

                     create a cemeteries champion seat on the Parks, Greenways, and Recreation Commission

                     conclude the Cemeteries Advisory Board effective June 30, 2019

                     amend the length of term clause

                     amend the membership attendance clause

                     amend the seat category on the Community Design Commission.

 

BE IT FURTHER RESOLVED that the Council calls a Public Hearing to amend subsections of Articles 8.3 and 8.4 of the Land Use Management Ordinance as it relates to Attendance at Meetings and Tenure at the Council’s November 14, 2018 meeting.

RECOMMENDATION: That the Council authorizes the Town Manager to act on the Council Committee on Boards and Commissions recommendations and calls a public hearing to amend the Land Use Management Ordinance.
