PROCEDURAL CONTEXT

The Land Use Management Ordinance, Town Code Appendix A Section 4.4 requires applicants to seek Council approval of any proposed zoning map amendment.

BACKGROUND AND CONTEXT

                     The applicant proposes converting vacant commercial space into 6 multifamily units. Please see the Staff Report for more information.

                     The Town Council previously approved development of this site in 2012 under a Special Use Permit. At the time, property to the south was included as part of the development. The proposed Conditional Zoning would replace the previous Special Use Permit for the subject property only.

                     In 2013, parties entered into a Consent Judgment where the landowner agreed to additional restrictions on development. The Consent Judgment remains in effect, and is referenced in Ordinance A.

TRADEOFFS, ALTERNATIVES, IMPACTS

Staff have reviewed the requested modification to regulations and find that the public purpose is served to an equivalent or greater degree

COMPLETE COMMUNITY CONNECTION

The property is a larger infill site served by existing infrastructure and located near a future Bus Rapid Transit station. For more analysis of Complete Community considerations, please see the Staff Report.

COMMUNITY ENGAGEMENT

Staff have provided mailed notice to neighbors and other notifications according to LUMO requirements. A public information meeting was held on April 10, 2025. Please see the Staff Report for more information.
