That the staff recommend Council adopt a resolution authorizing the Town Manager execute a private sewer easement on Town property to serve the property owner located at 416 Morgan Creek Road.

LEGISLATIVE CONTEXT*

As the request is to place a private easement on Town property, the Council must approve or deny this request.

BACKGROUND AND CONTEXT*

Property Owners will be building a new single-family home at 416 Morgan Creek Road.  Adjacent to the lot is a property owned by the Town, also known as ‘Merrit’s Pasture’. On the Town’s lot is an Orange Water and Sewer Authority (OWASA) public sanitary sewer main.  The property owner has requested a private easement to be placed on the Town’s property to connect to the OWASA sewer main.  The Town’s Public Works Department doesn’t have a problem with the Town agreeing to this private easement.

A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE A private sewer easement on Town Property to serve the PROPERTY OWNER LOCATED AT 416 MORGAN CREEK ROAD (2025-04-09/R-4)

 

WHEREAS, the property owner at 202 West Barbee Chapel Road has requested a private sewer easement on Town Property to serve its project located at 416 Morgan Creek Road; and

 

WHEREAS, the subject Town owned property is located west of 416 Morgan Creek Road; and

 

WHEREAS, both OWASA and the Town’s Public Works Department don’t have a problem with agreeing to this easement; and

 

WHEREAS, The property owner at 416 Morgan Creek Road will pay for any costs related to installing this sewer line. This includes preparing and recording the easement.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to execute a private sewer easement on Town Property to serve the Single-Family Home located at 416 Morgan Creek Road.
