Overview: After the Council approves the annual budget, periodic changes require the Town Council to amend the current budget.

Recommendation(s): |
That the Council:
• Adopt the resolution, accepting the Outside Agency FY 2023-24 funds for the Summer Youth Employment Program.
• Enact the attached budget ordinance amendment to adjust the General Fund, Grants Fund, Capital Projects Fund, Transit Fund, Parking Fund, and Public Housing Fund; and
• Enact the attached project ordinance amendment to adjust the Affordable Housing Fund and the 2015 Streets and Sidewalks Bond Fund.
Key Issues:
• General Fund
Summer Youth Employment Program Award - The Town of Carrboro has awarded the Town of Chapel Hill $10,340 for salaries to continue with the Summer Youth Employment Program for 7-8 Carrboro resident youth between the ages of 14-18 years old to participate in the Summer Youth Employment Program. Adopting the attached resolution authorizes acceptance of the Summer Youth Employment Award, and enacting the attached budget ordinance amendment establishes the grant budget of $10,340.
UNC Work Study - In the Fall of 2022, Library and Community Arts & Culture began using UNC Work Study students. Participating in UNC’s work study program supports Town goals of Diversity, Inclusion, and Town-Gown relationships; helps students defray the cost of higher education; and exposes a diverse array of young adults to a Public Service Mindset. The University agreed to pay 65% of paid wages as a reimbursement. The amount to be reimbursed is $6,500 to the Library and $4,500 to Community Arts & Culture. Enactment of the attached budget ordinance amendment would recognize the $11,000 from UNC and allocate those funds to the Library and Community Arts & Culture budgets.
• Grants Fund
2023-24 Governor’s Highway Safety Program Grant - At the October 25, 2023 business meeting, the Town received a grant in the amount of $102,600 from the Governor’s Highway Safety Program to continue the Town’s Vision Zero initiative. The Town has received an additional $30,200 from the Governor’s Highway Safety Program for this year’s grant, bringing the total to $132,800. The additional funding is to fund the conversion of the Complete Streets Specialist position from part-time to full-time. The funding will also cover the Vision Zero internship from May - September. The Town will contribute $8,919 from the General Fund to the grant to demonstrate support and commitment to Vision Zero. Enactment of the attached budget ordinance amendment recognizes and appropriates the additional $30,200 and $8,919 local match for the Vision Zero Initiative.
2022-23 Governor’s Highway Safety Program Grant Closeout - On October 12, 2023, the Town received a grant from the Governor’s Highway Safety Program in the amount of $60,500. A portion of this grant funded off-duty overtime for police officers to conduct high visibility crosswalk enforcement operations. Due to the timing of the hire of the Pedestrian Safety Position and non-linear Chapel Hill Police Department scheduling, a portion of these funds ($3,076) were unspent and need to be closed out for the grant period. Enactment of the attached budget ordinance amendment will reduce the grant revenue and expenditures in the amount of $3,076.
Ballistic Vest Partnership Grant - The Chapel Hill Police Department partners annually to share the cost of their ballistic vest purchases for sworn officers with the Bureau of Justice Assistance (BJA) through their Ballistic Vest Partnership (BVP) program. This is a fifty percent matching program where BJA will match fifty percent of every dollar that the police department spends on an approved vest. The award must be used for a National Institute of Justice (NIJ) compliant armored vest. Enactment of the attached budget ordinance amendment recognizes and appropriates $15,300 for the Ballistic Vest program.
Law Enforcement Mental Health & Wellness Act Environment Grant - The Chapel Hill Police Department was awarded a 2-year grant from the Attorney General of the United States and the Office of Community Oriented Policing Services under the FY23 Law Enforcement Wellness Act in the amount of $200,000. This grant will be used for personnel and programming. Enactment of the attached budget ordinance recognizes and appropriates $200,000 for Law Enforcement Mental Health & Wellness efforts.
• Capital Projects Fund
RAISE Grant - The Town received notice of award for a $1 million federal RAISE grant in June 2023. The grant will be used to hire a consultant to complete a feasibility study for the entire Everywhere-to-Everywhere Greenways network. The feasibility study will result in a complete package of fully vetted preliminary design plans for over 25 miles of greenways throughout Town. The grant requires a $300,000 local match, which will come out of the newly established annual greenways funding. Enactment of the attached budget ordinance recognizes and appropriates the $1 million federal RAISE grant towards the Everywhere-to-Everywhere Greenways project.
Fire Station #1 Asbestos Remediation - Public Works staff identified asbestos in the floor tile and floor tile adhesive that was beneath the carpet at Fire Station 1 during a floor replacement project. Funding in the amount of $43,178 is needed to test, monitor, and remediate the asbestos. Work is underway to immediately address this health and safety concern. Funding has been identified in the Capital Projects’ Fund Balance to address this need. Enactment of the attached budget ordinance appropriates $43,178 in fund balance for the Fire Station #1 Asbestos Remediation project.
• Transit Fund
Coronavirus Response and Relief Supplemental Appropriations Act (CRRSA) - The Town was awarded $3,566,655 in CRRSA funding to help respond to and recover from the COVID-19 pandemic. The application is for Fixed Route operational assistance and ADA Paratransit operating expenses, including operator and administrative salaries. These funds require no local match. Enactment of the attached budget ordinance recognizes and appropriates $3,566,655 in CRRSA funding.
Demand Response Replacement Vehicles - Five Demand Response vehicles need to be replaced in the current fiscal year. Staff recommends using $500,000 in fund balance for FY24 for the purchase of these five replacement vehicles. Enactment of the attached budget ordinance allocates $500,000 of Transit Fund fund balance for the purchase of Demand Response vehicles.
Fixed Route Replacement Buses - Staff recommends using $2 million from Transit Fund Balance to purchase Fixed Route buses to help us towards staying on course with the adopted Capital Plan. With the number of buses needing to be replaced, staff recommends purchasing 40’ clean diesel buses. The Chapel Hill Transit Partners have approved of this use of funds. Enactment of the attached budget ordinance allocates $2 million in Transit Fund fund balance for the purchase of Fixed Route replacement buses.
Automatic Vehicle Locator - Staff recommends moving $220,000 to upgrade the automatic vehicle locator system to improve customer access for trip planning. These funds will be used to continue the work already begun by the Town. Enactment of the attached budget ordinance allocates $220,000 in Transit Fund fund balance for the upgrade of the automatic vehicle locator system.
• Parking Fund
The Town was negotiating the parking lot expansion at the Rosemary/Graham lot through FY24. The revenue share due to the lot owner was not made in FY23 during the negotiation period. Therefore, the amount due of $30,455 is needed from Parking Fund fund balance. Enactment of the attached budget ordinance allocates $30,455 in Parking Fund fund balance for the payments to the lot owner.
• Public Housing Fund
Trinity Court will redevelop 40 existing, vacant public housing units and add 14 additional affordable housing units to the Town’s affordable housing inventory. Trinity Court will utilize the U.S. Department of Housing and Urban Development (HUD) Rental Assistance Demonstration Program (RAD) as well as Low Income Housing Tax Credits to finance the development along with funding from the Town’s Public Housing Fund. Construction for this project began in the summer of 2023. Enactment of the attached budget ordinance will appropriate $1.5 million Public Housing Fund fund balance for the Trinity Court Redevelopment project.
• Affordable Housing Fund
The Town has received $7,425 from community donations for the Emergency Housing Assistance Program. Enactment of the attached project ordinance amendment would recognize the community donations of $7,425 and would appropriate the funds to support rental assistance for low-income Chapel Hill residents through Orange County’s Emergency Housing Assistance program.
• 2015 Streets and Sidewalks Bond Fund
Homestead Road Sidewalk Project - The Homestead Road Sidewalks Improvements Project has higher than anticipated installation costs and the Metropolitan Planning Organization (MPO) approved additional funding in the amount of $560,000, with a local match of $140,000, in support of these construction costs on the project. The $140,000 local match has already been identified through the streets bonds issued in March 2023. Enactment of the attached project ordinance amendment would recognize and appropriate $560,000 from the MPO for the Homestead Road Sidewalk project.
Elliott Road Project - Per the Town Council Resolution (2018-04-25/R-10), as captured in the memorandum of understanding with the developer, The Park and Chapel Hill JV, LLC, the developer agrees to reimburse the Town for public improvements within the right-of-way as well as the increased design and construction costs associated with developer requested modifications to the new Elliott Road Extension roadway. Enactment of the attached project ordinance amendment would recognize and appropriate $650,528 for the Elliott Road Extension project.
Estes Drive Project - In early 2022 Town staff, Council, and residents met with representatives from NCDOT to discuss safety improvements to be made to the Estes Drive corridor after the tragic crash involving two middle school students in late 2021. After this meeting NCDOT committed to funding a Rectangular Rapid Flashing Beacon (RRFB) at the Estes/Granville crosswalk. NCDOT will add the cost of the RRFB and installation ($49,500) to the existing Estes Drive Bike-Ped Improvements contract. This is 100% State Secondary Road Maintenance funding and does not require a local match. Enactment of the attached project ordinance amendment would recognize and appropriate $49,500 towards the Estes Drive project.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE OUTSIDE AGENCY FUNDING FY 2023-2024 (2024-01-24/R-2)
WHEREAS, the Board of Alderman of the Town of Carrboro has made funds available for the salaries to implement a Summer Youth Employment Program for low-income youth in Carrboro; and
WHEREAS, the Board of Alderman of the Town of Carrboro has granted funds in the amount of $10,340; and
WHEREAS, the Town will use the funds for salaries to implement a Summer Youth Employment Program for youth between the ages of 14-18 years old who meet the income requirements and live in the Chapel Hill/Carrboro area.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to accept the Outside Agency FY 2023-24 funds and to make all necessary assurances.

BE IT ORDAINED by the Council of the Town of Chapel Hill that the Budget Ordinance entitled “An Ordinance Concerning Appropriations and the Raising of Revenue for the Fiscal Year Beginning July 1, 2023” as duly adopted on June 7, 2023, be and the same is hereby amended as follows:

AN ORDINANCE TO AMEND THE AFFORDABLE HOUSING FUND ORDINANCE (2024-01-24/O-2)
BE IT ORDAINED by the Council of the Town of Chapel Hill that, pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the Affordable Housing Fund Ordinance to provide funds to support affordable homeownership opportunities is hereby amended as follows:
“SECTION I
The Affordable Housing Fund Ordinance as authorized by the Town Council provides funds to purchase properties to create permanently affordable homeownership opportunities.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.
SECTION III
Revenues anticipated to be available to the Town are hereby amended as follows:

SECTION IV
Amounts appropriated to create permanently affordable homeownership opportunities are hereby amended as follows:

SECTION V
The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.
SECTION VI
Copies of this amended projects ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Business Management Director and Town Clerk.”

AN ORDINANCE TO AMEND THE 2015 STREETS AND SIDEWALKS BOND FUND FOR CAPITAL IMPROVEMENT PROJECTS (2024-01-24/O-3)
BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the following capital project is hereby amended for Streets and Sidewalk Improvements funded from 2015 General Obligation bonds approved by the voters in November 2015:
“SECTION I
The capital projects as authorized by bond referenda approved in November 2015, and as determined by the Town Council, includes streets and sidewalks capital improvements extending beyond one year.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.
SECTION III
Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

Amounts appropriated for capital projects are hereby amended as follows:

SECTION V
