STAFF RECOMMENDATION

Staff finds that the project, with the requested modifications to regulations and subject to the stipulations in Resolution A, can comply with all regulations of the Land Use Management Ordinance. The Town recommends Council evaluate the project under the applicable Finding(s) of Fact during an evidentiary hearing.

PROCEDURAL CONTEXT*

The Meadowmont Master Land Use Plan, stipulation 16, requires residential developments larger that two-family structures to be approved by the Town Council as a Special Use Permit.

Background and CONTEXT*

This site is located within the Meadowmont Master Land Use Plan area and must follow the regulations outlined in that plan. Town Council approved a Special Use Permit (SUP) for this site in 2010, for a project called Murray Hill which included the area considered in this application. This new proposal increases the total units on these parcels by 2 units and modifies the site layout from what was previously approved.

Tradeoffs, alternatives, impacts

Staff have reviewed the requested modification to regulations and find that the public purpose is served to an equivalent or greater degree by the requested modification. The modification is shown in Resolution A and the applicant materials.

Complete Community connection

Chapel Hill will direct growth to greenways, transit corridors, large infill sites with existing infrastructure, and smaller infill sites.

                     The location is a smaller infill lot within the larger Meadowmont development.

 

Goal 1: Plan for the Future Strategically

                     This site is not within a Future Land Use Map Focus Area.

                     The Future Land Use Map designates this land for High Residential development of generally 8-15+ units per acre.

 

Goal 2: Expand and Deliver New Greenways for Everyday Life

Associated Comp. Plan Elements: Mobility & Connectivity Plan and Connected Roads Plan

 

                     The property is on Meadowmont Lane, with bike lanes connecting to the Meadowmont Trail greenway. This trail connects to Harris Teeter and Rashkis Elementary.

                     The Chapel Hill Transit N-Route, which runs both during the week and weekends, has a stop 0.2 miles away from the site.

 

Goal 3: Be Green and Provide Housing

                     Development at this location could contribute to dense, walkable development patterns as called for in the Climate Action and Response Plan.

 

Goal 4: Plan for Excellence in the Public Realm and Placemaking

Planning staff have discussed the proposal with the Town’s Urban Designer. Preliminary observations include:

                     The site is a strong candidate for infill residential, given the surrounding development patterns and existing infrastructure.

                     The proposed buildings are located on Meadowmont Ln., with existing sidewalk. Many destinations are nearby in the Meadowmont community. This layout and context will support walkability.

COMMUNITY ENGAGEMENT

Staff have provided mailed notice to neighbors and other notifications according to LUMO requirements. A Public Information meeting was held for both the Special Use Permit and Concept Plan. Staff have not received significant numbers of phone calls or emails regarding the project.  

The following parties may participate in the evidentiary hearing, upon being sworn in: The applicant, the local government, and any person who would have standing to appeal the Council’s decision. Witnesses presenting competent, material, and substantial evidence as allowed by the Council.
