Overview: During the Spring and Summer of 2020, the Town of Chapel Hill participated in the collaborative update of the Eno-Haw Hazard Mitigation Plan. In addition to fostering interlocal cooperation, adopting this plan will allow the Town to remain eligible to receive Federal and State Hazard Mitigation Funding. Orange County has already adopted a resolution for this 2020 update, which is attached to this item.

That the Council adopt the resolution to adopt the 2020 Update to the Eno-Haw Hazard Mitigation Plan.
Key Points:
• The federal “Disaster Mitigation Act of 2000” (DMA 2000) (PL 106-390) requires local governments to adopt a hazard mitigation plan and update it every five years to be eligible for hazard mitigation funding.
• North Carolina General Statute §166A-19.41 requires that the eligible entity have an approved hazard mitigation plan to receive State public assistance funds following a disaster.
• The State of North Carolina Division of Emergency Management prioritizes planning funds for counties that collaborate with neighboring jurisdictions to create regional hazard mitigation plans.
• The Eno-Haw Regional Hazard Mitigation Plan was approved by the North Carolina Division of Emergency Management on May 25, 2015, by the Federal Emergency Management Agency on August 3, 2015, and by the Orange County Board of Commissioners on June 16, 2015.
• In Fall 2019, the Town of Chapel Hill joined Orange County, the Town of Carrboro, the Town of Hillsborough, the County of Durham and its encompassed municipalities, and the County of Alamance and its encompassed incorporated areas to update the 2015 Eno-Haw Regional Hazard Mitigation Plan. John Richardson, Community Resilience Officer for the Town of Chapel Hill served on this planning group.
• The Town of Chapel Hill retained specific mitigation actions that pertain directly to Chapel Hill, within the regional plan.

• No local control is lost by any participating entity in the region, and each participant retains the right to apply for State or Federal funding. An additional benefit of this partnership is that any combination of participants can choose to share the cost of any required local match when applying for project funding.
• By adopting the updated Eno-Haw Regional Hazard Mitigation Plan, the Town of Chapel Hill will remain eligible for federal and state hazard mitigation and disaster assistance funds.
Fiscal Impact/Resources: Collaboration on the plan allows for efficient use of the Town’s resources. There are no direct financial impacts associated with adopting the Eno-Haw Regional Hazard Mitigation Plan.

A RESOLUTION ADOPTING THE ENO-HAW REGIONAL HAZARD MITIGATION PLAN (2021-03-10/R-2)
WHEREAS, the federal “Disaster Mitigation Act of 2000” (PL 106-390) requires local governments to adopt a mitigation plan in order to be eligible for hazard mitigation funding; and
WHEREAS, Federal mitigation planning regulations require local mitigation plans to be updated and resubmitted to the Federal Emergency Management Agency for approval every five years in order to continue eligibility for Federal Emergency Management Agency hazard mitigation assistance programs; and
WHEREAS, North Carolina General Statute §166A-19.41 requires local governments to have an approved hazard mitigation plan in order to receive state public assistance funds; and
WHEREAS, the Council of the Town of Chapel Hill desires to remain eligible for hazard mitigation funding and public assistance disaster relief funds; and
WHEREAS, Town staff along with representatives from partnering jurisdictions, in conjunction with contract services, have performed a comprehensive review and evaluation of the newly- created Eno-Haw Regional Hazard Mitigation Plan and have updated the plan as required under regulations at 44 CFR Part 201 and according to guidance issued by the North Carolina Division of Emergency Management; and
WHEREAS, the Eno-Haw Regional Hazard Mitigation plan formalizes the regional partnerships necessary to strategically and efficiently reduce and eliminate long-term risk to our citizens and their property from hazards; and
WHEREAS, the North Carolina Division of Emergency Management has deemed the Eno-Haw Regional Hazard Mitigation Plan compliant with Section 322 of the Disaster Mitigation Act of 2000, as well as with relevant state requirements; and
WHEREAS, the Federal Emergency Management Agency has deemed the Eno-Haw Regional Hazard Mitigation Plan compliant with Section 322 of the Disaster Mitigation Act of 2000.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby adopts, by way of this resolution, the “Eno-Haw Regional Hazard Mitigation Plan” as approved by the North Carolina Division of Emergency Management and the Federal Emergency Management Agency.
