A RESOLUTION MAKING A RECOMMENDATION TO THE ORANGE COUNTY BOARD OF COMMISSIONERS REGARDING THE ETJ/JPA SEATS ON THE CHAPEL HILL BOARD OF ADJUSTMENT (2021-04-07/R-9)
WHEREAS, the Orange County Board of Commissioners has a resolution regarding the Orange County Appointment and Orientation Process for Boards and Commissions that specifies “… When a vacancy exists, the municipality will be requested to provide to the Board of County Commissioners a resolution with a recommendation for that vacancy;” and
WHEREAS, despite multiple recruitment efforts, the County has not received any applications from residents within Chapel Hill’s Extraterritorial Jurisdiction or within the Joint Planning Area. Per the Joint Planning Agreement, the positions may be filled with Town residents; and
WHEREAS, the Chapel Hill Board of Adjustment has reviewed the viable applications and made a recommendation to the Chapel Hill Town Council; and
WHEREAS, a Council Interview Committee for Semi-Autonomous Boards reviewed the viable applications and made a recommendation to the Chapel Hill Town Council.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council recommends the Orange County Board of Commissioners reappoint Daniel Hatley to the County Alternate ETJ/JPA position on the Chapel Hill Board of Adjustment.

RECOMMENDATION: The Council Committee: Board of Adjustment Interviews met between 1-1:16 PM on Wednesday, March 31 with Council Members Gu and Parker present and Council Member Buansi absent. The Committee made the following recommendation(s) to the Town Council for consideration:
• Daniel Hatley, Reappointment, County JPA/ETJ
SPECIAL REQUEST(s): No Comment
BACKGROUND: The Council Interview Committee supports the Board of Adjustment recommendation.
• Mr. Hatley has served for one full term. His background as an attorney and real estate broker are a good match for this board.
Note: Communications and Public Affairs notes that the Council Committee: Board of Adjustment Interviews reviewed the following application: Daniel Hatley. The Board, Committee and Council will consider the Town-appointed seats in May.
The Council will need to adopt a resolution to transmit a recommendation to the Orange County Board of Commissioners (BOCC) for consideration at its upcoming meeting for the County JPA/ETJ seat.
Reappointment Process for the Board of Adjustment BOCC-appointed position
• The CHBOA made a recommendation for reappointment to Council on March 4.
• The Council Semi-Autonomous Board Interview Committee made recommendation.
• April 7 Council makes recommendation to the BOCC.
• The BOCC meets April 22 to discuss applications at their Work Session and makes appointments on May 4 on consent.
