Reopen the legislative hearing, receive public comment, provide feedback on the application, and consider action.

PROCEDURAL CONTEXT

The Land Use Management Ordinance (LUMO), Town Code Appendix A Section 4.4 requires applicants to seek Council approval of any proposed zoning map amendment. State Statute § 160D-703 specifies that only those conditions consented to by the property owner(s) in writing may be incorporated into the Conditional Zoning.

BACKGROUND AND CONTEXT

The applicant proposes 315-350 multifamily units with a ground floor retail component in a five-story building. Council voted to enact an ordinance approving the application on April 9, 2025. The application is returning for continued discussion around conditions of approval for affordable housing. Please see the Staff Report for more information.

TRADEOFFS, ALTERNATIVES, IMPACTS

Staff have reviewed the requested modification to regulations and find that the public purpose is served to an equivalent or greater degree. The applicant will share more information at the meeting about alternatives for providing affordable housing.

COMPLETE COMMUNITY CONNECTION

The property is an infill and redevelopment site served by existing infrastructure. It is located near proposed greenways and similarly dense development. For more analysis of Complete Community considerations, please see the Staff Report.

COMMUNITY ENGAGEMENT

Staff provided an additional mailed notice to neighbors and other notifications for the reopening of the hearing. A public information meeting was held on October 8, 2024. Staff have not received significant numbers of phone calls or emails regarding the project. Please see the Staff Report for more information.
