STAFF RECOMMENDATION
That the Council:
• Enact the attached budget ordinance amendment to adjust the General Fund, Capital Improvement Fund, Library Gift Fund, Transit Fund, and Parking Fund.
• Enact the attached project ordinance amendments to adjust the 2015 Street and Sidewalks Fund, Affordable Housing Fund, 2021 Limited Obligation Bonds (LOBS) Fund, and Capital Projects Ordinance Fund.

ACTION/DECISION POINTS
By enacting the budget ordinance amendment, the Council adjusts the budgets for the General Fund, Capital Improvement Fund, Library Gift Fund, Transit Fund, and Parking Fund. By enacting the project ordinance amendments, the Council adjusts the budgets for the 2015 Streets and Sidewalks Bond Fund, Affordable Housing Fund, 2021 Limited Obligation Bonds (LOBS) Fund, and Capital Projects Ordinance Fund.
LEGISLATIVE CONTEXT
After the Council approves the annual budget, periodic changes require the Town Council to amend the current budget, as described in state statute 159-15.
BACKGROUND AND CONTEXT
General Fund:
Sales Tax Article 46 Funds - Enactment of the budget ordinance amendment would appropriate the $37,788 in Article 46 funds from Orange County for small business support and marketing efforts.
Occupancy Tax - Enactment of the budget ordinance amendment would reflect the additional payment of $381,855 made to the Visitors Bureau from appropriated fund balance.
Durham Technical Community College (DTCC) - Enactment of the budget ordinance amendment would recognize the contribution of $15,000 from DTCC and allocate those funds towards training needs.
Capital Improvement Fund:
U.S. Conference of Mayors Grant - Enactment of the budget ordinance amendment recognizes and appropriates the $125,000 grant for the Wheels of Wellness program.
Library Gift Fund:
State Library additional funding - Enactment of the budget amendment recognizes and appropriates $1,406 for library supplies and technology.
Library Foundation donation - Enactment of the budget ordinance amendment recognizes and appropriates the $6,000 for a library mural.
Transit Fund:
North South Bus Rapid Transit (NCBRT) Grant - Enactment of the budget ordinance amendment recognizes and appropriates $8,134,600 for development activities related to the NSBRT project.
Parking Fund:
Parking Fund Balance - Enactment of the budget ordinance amendment allocates an additional $490,000 in fund balance, reduces East Rosemary Parking Deck anticipated revenues, and increases Wallace Deck revenues.
2015 Streets & Sidewalks Bond Fund:
Estes Drive Bicycle & Pedestrian Improvements - Enactment of the project ordinance amendment increases the OWASA reimbursement by $6,337.
Affordable Housing Fund:
Interest Income - Enactment of the attached project ordinance amendment would recognize and allocate $67,278 in interest income for the Town’s Affordable Housing Plan.
2021 Limited Obligation Bonds (LOBS) Fund:
Bond Proceeds and Premium - Enactment of the project ordinance amendment will reduce the proceeds by $66,938 and premium by $9,691 to align with actuals and reduce project expenditures accordingly.
Capital Projects Ordinance Fund:
Rogers Road - Enactment of the project ordinance amendment will recognize $74,239 in interest income and allocate those funds toward the FY25 annual commitment to Rogers Road.

BE IT ORDAINED by the Council of the Town of Chapel Hill that the Budget Ordinance entitled “An Ordinance Concerning Appropriations and the Raising of Revenue for the Fiscal Year Beginning July 1, 2024” as duly adopted on June 5, 2024, be and the same is hereby amended as follows:

AN ORDINANCE TO AMEND THE 2015 STREETS AND SIDEWALKS BOND FUND FOR CAPITAL IMPROVEMENT PROJECTS (2025-04-09/O-2)
BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the following capital project is hereby amended for Streets and Sidewalk Improvements funded from 2015 General Obligation bonds approved by the voters in November 2015:
“SECTION I
The capital projects as authorized by bond referenda approved in November 2015, and as determined by the Town Council, includes streets and sidewalks capital improvements extending beyond one year.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.
SECTION III
Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

Amounts appropriated for capital projects are hereby amended as follows:

SECTION V
The Town Manager is hereby directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.
SECTION VI
Copies of this amended projects ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Business Management Director and Town Clerk.”

AN ORDINANCE TO AMEND THE AFFORDABLE HOUSING FUND ORDINANCE (2025-04-09/O-3)
BE IT ORDAINED by the Council of the Town of Chapel Hill that, pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the Affordable Housing Fund Ordinance to provide funds to support affordable homeownership opportunities is hereby amended as follows:
“SECTION I
The Affordable Housing Fund Ordinance as authorized by the Town Council provides funds to purchase properties to create permanently affordable homeownership opportunities.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.

Revenues anticipated to be available to the Town are hereby amended as follows:

AN ORDINANCE TO AMEND THE CAPITAL PROJECTS ORDINANCE FOR THE ROSEMARY PARKING DECK, PUBLIC ROADWAY IMPROVEMENTS, LADDER TRUCK, AND FURNITURE & FIXTURES FOR THE NEW POLICE STATION FUNDED FROM LIMITED OBLIGATION BONDS (2025-04-09/O-4)
BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 49 of Chapter 159 of the General Statutes of North Carolina, that the capital projects ordinance established for the East Rosemary Parking Deck, public roadway improvements, ladder truck, and furniture & fixtures for the new police station funded from limited obligation bonds is hereby amended as follows:
“SECTION I
The capital projects as authorized by the Town Council include Rosemary Street Parking Deck and Ephesus Fordham Phase II - Elliott Road Reconstruction funded from the 2021 Limited Obligation Bonds and the Rosemary Street Parking Deck, Ladder Truck, Furniture & Fixtures for the new Police Station from the 2024 Limited Obligation Bonds for projects extending beyond one year.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated herein.
SECTION III
Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the capital project ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:
“SECTION I
The capital projects as authorized by the Town Council include various capital projects funded from grants, the Capital Improvements Program funds, and other miscellaneous sources of revenues for a variety of projects extending beyond one year.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.
