That the Council:

                     Enact the attached budget ordinance amendment to adjust the General Fund, Grants Fund, Library Gift Fund, Climate Action Fund, Vehicle Replacement Fund, Debt Fund, and Parking Fund

                     Enact the attached project ordinance amendments to adjust the 2015 Street and Sidewalks Fund and Community Development Block Grant Fund.

ACTION/DECISION POINTS

By enacting the budget ordinance amendment, the Council adjusts the budgets for the General Fund, Grants Fund, Library Gift Fund, Climate Action Fund, Vehicle Replacement Fund, Debt Fund, and Parking Fund.  By enacting the project ordinance amendments, the Council adjusts the budgets for the 2015 Streets and Sidewalks Bond Fund and the Community Development Block Grant Fund.

LEGISLATIVE CONTEXT

After the Council approves the annual budget, periodic changes require the Town Council to amend the current budget, as described in state statute 159-15.

BACKGROUND AND CONTEXT

General Fund:

NC Office of the State Fire Marshall (NC OFSM) Camp Ignite Grant - Enactment of the budget ordinance amendment would recognize and appropriate $7,500 from the NC OFSM for the Camp Ignite Program.

Traffic Revenue in Lieu - Enactment of the budget ordinance amendment would recognize and appropriate $5,000 from Trinsic Residential Builders for work at the Martin Luther King Jr. Blvd. and Estes Dr. intersection.

Grants Fund:

ABC Grant - Enactment of the budget ordinance amendment recognizes and appropriates $40,000 to support Police Department alcohol law enforcement efforts.

Mobile Crisis Unit - Enactment of the budget ordinance amendment recognizes and appropriates $207,036 from Orange County for the Mobile Crisis Unit.

Library Gift Fund:

LSTA Grant - Enactment of the budget ordinance amendment recognizes and appropriates $50,000 for the Chapel Hill Descendants Project.

Climate Action Fund:

Energy Efficiency & Conversation Block Grant (EECBG) - Enactment of the budget ordinance amendment recognizes and appropriates $129,010 from the US Department of Energy to support energy efficiency and carbon reduction activities in Chapel Hill.

Vehicle Replacement Fund:

Green Vehicle Purchases - Enactment of the budget ordinance amendment transfers $129,200 from the Climate Action Fund to the Vehicle Replacement Fund to support the purchase of electric vehicles.

Debt Fund:

2024 Limited Obligation Bonds - Enactment of the budget ordinance amendment will appropriate $565,937 for the FY 2025 debt service on the 2024 Limited Obligation Bonds.

Parking Fund:

2024 Limited Obligation Bonds - Enactment of the budget ordinance amendment will appropriate $1,167,007 for the FY 2025 debt service on the 2024 Limited Obligation Bonds.

2015 Streets and Sidewalks Bond Fund:

NCDOT Reimbursement - Enactment of the project ordinance amendment will recognize and appropriate $226,919 from NCDOT for the Elliott Road Extension project.

Bulbrook Reimbursement - Enactment of the project ordinance amendment will recognize allocate the $13,000 reimbursement towards the Elliott Road Extension project.

Art-Designed Bike Rack - Enactment of the project ordinance amendment will recognize and allocate the $750 donation to support the bike rack project.

Community Development Block Grant Fund:

2016-17 CDBG - Enactment of the project ordinance amendment will unrecognize $404 to closeout the grant.

2020 CDBG CARES - Enactment of the project ordinance amendment will unrecognize $1 to closeout the grant.

BE IT ORDAINED by the Council of the Town of Chapel Hill that the Budget Ordinance entitled “An Ordinance Concerning Appropriations and the Raising of Revenue for the Fiscal Year Beginning July 1, 2024” as duly adopted on June 5, 2024, be and the same is hereby amended as follows:

AN ORDINANCE TO AMEND THE 2015 STREETS AND SIDEWALKS BOND FUND FOR CAPITAL IMPROVEMENT PROJECTS (2024-10-09/O-2)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the following capital project is hereby amended for Streets and Sidewalk Improvements funded from 2015 General Obligation bonds approved by the voters in November 2015:

 

“SECTION I

 

The capital projects as authorized by bond referenda approved in November 2015, and as determined by the Town Council, includes streets and sidewalks capital improvements extending beyond one year.

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.

 

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

Amounts appropriated for capital projects are hereby amended as follows:

The Town Manager is hereby directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.

AN ORDINANCE AMENDING THE 2016-17 COMMUNITY DEVELOPMENT ENTITLEMENT GRANT PROJECT ORDINANCE (2024-10-09/O-3)

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following grant project is hereby amended as follows:

SECTION I

The projects authorized are the Community Development projects as approved by the Council on April 11, 2016 funds are as contained in the Funding Approval and Grant Agreement between the Town and the U.S. Department of Housing and Urban Development (HUD). The projects are known more familiarly as the 2016 Entitlement Community Development Block Grant. The grant activities include housing rehabilitation, homebuyer assistance programs, community services to low-income residents, and administration costs for the program.

SECTION II

The Manager of the Town of Chapel Hill is hereby directed to proceed with the grant project within the terms of the grant document(s), the rules and regulations of the U.S. Department of Housing and Urban Development, and the budget contained herein.

SECTION III

The following revenues are anticipated to be available to complete the project:

Amounts appropriated for projects are as follows:

The Director of Business Management is hereby directed to maintain within the Grant Project Fund sufficient detailed account records to provide the accounting to the U.S. Department of Housing and Urban Development as required by the grant agreement(s) and Federal and State regulations.

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget and shall keep the Council informed of any unusual occurrences.

SECTION VII

Copies of this project ordinance shall be entered into the minutes of the Council and copies be filed within five days of adoption with the Manager, Business Management Director, and Town Clerk.”

AN ORDINANCE AMENDING THE COMMUNITY DEVELOPMENT ENTITLEMENT GRANT-CORONAVIRUS FUNDS PROJECT ORDINANCE (2024-10-09/O-4)

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following grant project is hereby amended as follows:

SECTION I

The projects authorized are the Community Development projects as approved by the Council on May 6, 2020 funds are as contained in the Funding Approval and Grant Agreement between the Town and the U.S. Department of Housing and Urban Development (HUD). The projects are known more familiarly as the 2020 Entitlement Community Development Block Grant-Coronavirus Funds. The grant activities include homelessness case management and rental and homeownership assistance.

SECTION II

The Manager of the Town of Chapel Hill is hereby directed to proceed with the grant project within the terms of the grant document(s), the rules and regulations of the U.S. Department of Housing and Urban Development, and the budget contained herein.

The following revenues are anticipated to be available to complete the project:
