Overview: The Town’s Public Housing Department receives its operating subsidies (Operating Funds and Capital Funds) from the U.S. Department of Housing and Urban Development (HUD) for the maintenance and preservation of its properties. The FY 23 grant is $231,958 more than anticipated. This memo identifies the proposed uses and seeks council approval of the proposal.

That Council adopt a resolution and enact a project ordinance amendment approving the additional $231,958 in Capital Grant Funds for FY23.
Background:
Proposed Amendment:
• Council approved the Public Housing Capital Fund Ordinance on June 8, 2022 (2022-06-08/R-2)
• Housing & Urban Development (HUD) released their 2022/2023 awards in August 2023.
• Award is $231,958 more than was anticipated.
• Council approval is required to amend the project ordinance.
• Proposed Amendment allocates more funding to cabinet renovations and appliance upgrades which would allow us to serve more of the Public Housing apartments.
Next Steps:
• If the amendment is approved by the Council, we would forward the amended plan to HUD for approval.
Fiscal Impact:
• Enactment of the Ordinance would budget $231,958 more for eligible Capital Fund activities.

A RESOLUTION AMENDING THE FY 23 CAPITAL FUND GRANT FROM THE US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (2022-09-28/R-2)
WHEREAS, The Town had not yet received confirmation of the 2022-2023 Capital Fund Grant by the United States Department of Housing and Urban Development (HUD) when the Capital Fund Program for Public Housing Renovations was approved on June 8, 2022; and
WHEREAS, the Council has received the proposed 2022-2023 Capital Fund Grant from HUD.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council recognizes an amended FY 2023 Capital Fund Grant amount of $1,167,218.
BE IT FURTHER RESOLVED that the Council approves the following activities for use of the FY 23 Capital Fund Grant:

AN ORDINANCE TO AMEND A CAPITAL FUND PROGRAM (CFP) PROJECT ORDINANCE (2022-09-28/O-1)
BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following project ordinance is hereby amended as follows:
“SECTION I
The project authorized is the Public Housing Capital Fund Project budget as approved by the Council on June 8, 2022.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation with the project within the terms of the Contract document(s), the rules and regulations of the U.S. Department of Housing and Urban Development, and budget contained herein.
SECTION III
SECTION IV
The amounts appropriated for the project are established as follows:

The Finance Officer of the Town of Chapel Hill is hereby directed to maintain within the Project Fund sufficient specific detailed accounting records to provide the accounting to the U.S. Department of Housing and Urban Development as required by the Annual Contributions Contract and federal regulations.
SECTION VI
Funds may be advanced from General funds for the purpose of making payments as due. Reimbursement requests should be made to HUD in an orderly and timely manner.
SECTION VII
The Manager is directed to report annually on the financial status of each project in Section IV and on the total revenues received.”
