Approve the Miscellaneous Budget Ordinance Amendment to Adjust Various Fund Budgets for FY 2022-23.

Overview: After the council approves the annual budget, periodic changes require the Town to amend the current budget.

Recommendation(s): |
That the Council:
• Enact the attached budget ordinance amendment to adjust the General Fund, Grants Fund, Climate Action Fund, and Library Gift Fund; and
• Enact the attached project ordinance amendment to adjust the Transitional Housing Fund, Capital Projects Ordinance Fund, and the 2021 Two-Thirds Bonds Fund.
• Adopt the attached resolutions to accept the Alcohol Beverage Control (ABC) Grant, Governor’s Highway Safety Grant, and Blue Cross Blue Shield Grant.
Key Issues:
• General Fund
Booker Creek Trail murals project donation - The New Hope Audubon Society has donated $2,000 to the Town in support of the Town’s Pipes Murals Program to install art on the Booker Creek Trail. Enactment of the attached budget ordinance amendment would recognize and appropriate the $2,000 for use towards the murals project.
Botanical Gardens Land Purchase - On November 17, 2021, Town Council adopted a Resolution (2021-11-17/R-2) authorizing the Manager to enter into an agreement with the NC Botanical Garden Foundation, Inc. to provide $100,000 in Town funding toward the purchase of approximately 25 acres of privately held property, identified as Orange County GIS PIN 9787650461. The NC Botanical Garden and the NC Botanical Garden Foundation, Inc. desire to add this property to the existing Stillhouse Bottom Nature Preserve adjacent to Morgan Creek. An Agreement between the Town and NC Botanical Garden Foundation, Inc. has been prepared and is ready for execution upon establishment of funding for the purchase. Enactment of the attached budget ordinance amendment would appropriate $100,000 in General Fund fund balance towards this property purchase.
Collaborative Outreach Program - Orange County established a Collaborative Outreach program (Sales Tax Article 46), making funds available for economic development programs that aid in job creation, drive economic growth, support existing businesses, recruit new businesses, and promote other activities such as innovation and entrepreneurial growth, agri-tourism and agriculture in Orange County. Orange County has allocated $39,600 in funding based on population for each county municipality.
This year’s allocation will support the Launch business accelerator program as it expands event programming and transitions to their new space at the Innovation Hub. Enactment of the attached budget ordinance amendment would recognize and appropriate the $39,600 in Article 46 funds from Orange County.
Street Resurfacing - The September 14, 2022 carryover budget amendment failed to include $635,068 in unspent street resurfacing funding from FY 2022. This funding is predominately comprised of excess fund balance that was unable to be spent prior to the end of the fiscal year. Enactment of the attached budget ordinance amendment would appropriate $635,068 in General Fund fund balance for street resurfacing.
• Grants Fund
Governor’s Highway Safety Program Grant - The Town received a grant from the Governor’s Highway Safety Program to continue the Town’s Vision Zero initiative. The funds are primarily for our part-time Complete Streets Specialist and off-duty overtime for police officers to conduct high visibility crosswalk enforcement operations. We will hold public events and workshop to increase awareness of Vision Zero and identify small quick build projects around Town that will improve road safety. Adopting the resolution authorizes acceptance of the Governor’s Highway Safety Grant and enacting the budget ordinance amendment establishes the grant budget of $60,500.
Alcohol Beverage Control (ABC) Board Grant - The Orange County ABC Board awarded the Town of Chapel Hill $37,000 to continue supporting the Police Department’s alcohol law enforcement efforts. These funds will be used for overtime salaries and special use funds for alcohol operations, equipment and supplies relating to those operations, and fuel and maintenance for the Town’s designated vehicle used during those operations. There are no matching requirements for this grant. Adoption of the attached resolution authorizes acceptance of the ABC Grant, and enactment of the attached budget ordinance amendment establishes the grant budget of $37,000.
Blue Cross Blue Shield Grant - The Town received a $375,000 grant from Blue Cross Blue Shield Foundation NC for implementation of the Building Integrated Communities (BIC) Action Plan, which will be dispersed over three years in $125,000 increments annually beginning in FY 2023. The Town has received the first installment and plans to use this funding to hire staff to support BIC Action Plan implementation as well as support outreach and engagement activities with immigrant and refugee residents. Adoption of the attached resolution authorizes acceptance of the Blue Cross Blue Shield Grant, and enactment of the attached budget ordinance amendment establishes the grant budget of $125,000.
• Climate Action Fund
Mobile Source Emissions Reduction Program Grant - The Town has been awarded $211,749 from the NC Department of Environmental Quality to cover the premium associated with replacing one of our diesel refuse trucks with an all-electric option. This is an important pilot because refuse vehicles offer significant emissions reduction benefits based on their size and mileage. The vehicle would be charged overnight at Public Works using a new DC fast charging station that is included with the grant. This project supports the Town’s Climate Action and Response Plan by helping us continue to transition our fleet to zero tailpipe emission electric vehicles. Enactment of the attached budget ordinance amendment would recognize and appropriate the $211,749 for the costs associated with replacing a diesel refuse truck with an all-electric option.
Volkswagen Settlement Grant Program - The Town has been awarded $25,000 from the NC Department of Environmental Quality to support the installation of 20 electric vehicle charging stations as part of the redevelopment of the municipal parking deck at 125 East Rosemary Street. The Town is working with the EV Direct program of Duke Energy One to complete the installation. In addition to the 5-year warranty that is required by the grant, we will also purchase a maintenance plan to ensure that the chargers will remain in good working order. This grant supports the Town’s Climate Action and Response Plan by creating additional public charging infrastructure to help our community transition to zero tailpipe emission electric vehicles. Enactment of the attached budget ordinance amendment would recognize and appropriate the $25,000 towards the purchase of charging stations at the parking deck at 125 East Rosemary Street.
• Library Gift Fund
Lipman Endowment - The Lipman Trust contributes annually to the Lipman Endowment within the Library Gift Fund. The Library will use these funds for web design/development and for the installation of outdoor security fencing at the Library. Enactment of the attached budget ordinance amendment will allocate $55,000 from the Lipman Endowment in the Library Gift Fund fund balance for improvements at the Library.
Keystone Species Project - A donation was received late in FY22 in the amount of $900 for the Keystone Species Project. This donation to the Library was to purchase and plant a variety of native “keystone” plants and fruit trees to be installed in Pritchard Park outside the Chapel Hill Public Library. Enactment of the attached budget ordinance amendment would appropriate $900 in Library Gift Fund fund balance towards this project.
LSTA Bright Ideas Grant - The Library has received a $11,820 LSTA SLNC Bright Ideas Grant from the State Library of North Carolina to create services (collections, spaces, programs) for people whose brains function differently than what is considered typical or standard. Library will create sensory kits focused on dementia care and individuals with sensory processing issues, plan and execute sensory story times, and develop a sensory trail in Pritchard Park. Enactment of the attached budget ordinance amendment would recognize and appropriate the $11,820 towards the project.
Department of Natural & Cultural Resources (DNCR) - The Library is the recipient of special one-time funds from the US Treasury Office as part of the Coronavirus State Fiscal Recovery Funds under the American Rescue Plan Act. Chapel Hill Public Library will receive $54,775 to contract for design and construction of a gender-neutral restroom in the library, purchase of content filtering software, and to offer departmental incentive pay. Enactment of the attached budget ordinance would recognize and appropriate the $54,775 towards the project.
New Hope Audubon Society - The Library has received a donation from the New Hope Audubon Society in the amount of $1,000 for a sensory trail project. The donation will be used to purchase and plant a variety of native larval host plants to improve the bird habitat and enhance sensory experiences around the bird blind and story walk trail outside the library. Enactment of the attached budget ordinance would recognize and appropriate the $1,000 donation towards the sensory trail project.
• Transitional Housing Fund
The Town manages a Transitional Housing program the provides opportunities for families to move from public housing to the private housing market. The ten transitional units are located on St. Andrews Lane, Weatherstone Drive, South Merritt Mill Road, Sykes Street and Hillsborough Street. Approval of the attached project ordinance amendment would recognize program income of $50,052 and appropriate it for use in maintaining the properties.
• Capital Projects Ordinance Fund/2021 Two-Thirds Bonds Fund
In order to complete the Hargraves Park Tennis Court Project and bring the project budget in line with the project design firm’s Opinion of Probable Construction Cost (OPCC), $358,600 is needed from 4 other projects within the 2021 Two-Thirds Bonds Fund. The projects affected are the Hargraves Park Ballfield Renovation, Hargraves Park Playground, Hargraves Park AD Swimming Pool, and Ephesus Park Tennis and Pickleball Court Repairs. Additionally, $79,800 in recreation area payment-in-lieu development fees are needed to complete the project. The Hargraves Park Tennis Court Project will include the resurfacing of the existing tennis courts, addition of new LED lights, and an accessible sidewalk from the parking lot to the tennis courts. Enactment of the attached project ordinance amendment would transfer $358,600 from existing projects to the Hargraves Park Tennis Court Project in the 2021 Two-Thirds Bonds Fund. Enactment of the attached project ordinance would recognize $79,800 in payment-in-lieu funds and allocate the funds towards the project in the Capital Project Ordinance Fund.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE ORANGE COUNTY ALCOHOLIC BEVERAGE CONTROL BOARD FUNDS (2022-10-12/R-2)
WHEREAS, the Orange County Alcoholic Beverage Control (ABC) Board Funds through the ABC Board has made funds available for Alcohol Law Enforcement for the Town of Chapel Hill; and
WHEREAS, the ABC Board has awarded funds in the total for the amount of $37,000; and
WHEREAS, the funds would be used for overtime salaries and special use funds for alcohol operations, equipment and supplies relating to those operations, and fuel and maintenance for the Town’s designated vehicle used during those operations;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manger to accept the ABC Board Funds and to make all necessary assurances.

WHEREAS, the Governor’s Highway Safety Program has made funds available for pedestrian safety initiatives for the Town of Chapel Hill; and
WHEREAS, the Governor’s Highway Safety Program has awarded funds for a total amount of $60,500; and
WHEREAS, the funds would be used for a program support position, police overtime, and supplies relating to the project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to accept the Governor’s Highway Safety Grant and to make all necessary assurances.

WHEREAS, the Governor’s Highway Safety Program has awarded funds for a total amount of $125,000; and
WHEREAS, the funds would be used for staff, outreach and engagement activities with immigrant and refugee residents.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to accept the Blue Cross Blue Shield Foundation NC Grant and to make all necessary assurances.

BE IT ORDAINED by the Council of the Town of Chapel Hill that the Budget Ordinance entitled “An Ordinance Concerning Appropriations and the Raising of Revenue for the Fiscal Year Beginning July 1, 2022” as duly adopted on June 8, 2022, be and the same is hereby amended as follows:

AN ORDINANCE TO AMEND THE TRANSITIONAL HOUSING PROGRAM PROJECT ORDINANCE (2022-10-12/O-2)
BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the Transitional Housing Program Projects Ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:
“SECTION I
The project authorized is the Transitional Housing Program for Public Housing Families as approved by the Town Council on April 23, 2001.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with the project within the rules and regulations of the program, and the budget contained herein.
SECTION III
The following revenue is available to complete the project:

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the capital project ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:
“SECTION I
The capital projects as authorized by the Town Council include various capital projects funded from grants, the Capital Improvements Program funds, and other miscellaneous sources of revenues for a variety of projects extending beyond one year.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.
SECTION III
Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

Amounts appropriated for capital projects are hereby amended as follows:

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.

BE IT ORDAINED by the Council of the Town of Chapel Hill that, pursuant to Section 49 of Chapter 159 of the General Statutes of North Carolina, the following capital project is hereby amended for parks and recreation, public safety, and streets and sidewalks projects funded from the 2021 Two-Thirds General Obligation Bonds.
“SECTION I
The capital projects as authorized by General Statute, and as determined by the Town Council, includes the capital costs of parks and recreation, public safety, and streets and sidewalks.
SECTION II
The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.
SECTION III
Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:
