STAFF RECOMMENDATION

Open the legislative hearing, receive public comment, provide feedback on the application, and continue the hearing to October 8th, 2025.

Following the hearing, staff recommend that Council approve the project and the requested modifications to regulations, subject to the conditions in Ordinance A.

PROCEDURAL CONTEXT

The Land Use Management Ordinance, Town Code Appendix A Section 4.4 requires Council approval of any proposed zoning map amendment.

BACKGROUND AND CONTEXT

The applicant proposes vertical mixed-use project of small-scale retail and 175 to 200 multifamily units in a 9-story building with structured parking. Please see the Staff Report for more information.

TRADEOFFS, ALTERNATIVES, IMPACTS

Staff have reviewed the requested modification to regulations and find that the public purpose is served to an equivalent or greater degree. Please see the Staff Report for more information.

COMPLETE COMMUNITY CONNECTION

The property is an infill site served by existing infrastructure located in the future Bus Rapid Transit corridor. For more analysis of Complete Community considerations, please see the Staff Report.

COMMUNITY ENGAGEMENT

Staff provided mailed notices to neighbors and posted an informational sign at the site, in addition to other notifications according to LUMO requirements. A public information meeting was held on April 8, 2025. Planning Commission reviewed the application at a public meeting on August 19, 2025. Staff have not received significant numbers of phone calls or emails regarding the project.
