Overview: In 2019, the Planning Commission submitted a petition requesting information pertaining to bicycle and pedestrian payments-in-lieu to assist them in determining if and when to grant a developer’s request to be waived from implementing such improvements. Planning staff compiled data related to past payments-in-lieu and found that there is not clear guidance on allowing and determining payments-in-lieu in the Land Use Management Ordinance (LUMO). This text amendment will specify the circumstances under which a payment-in-lieu may be made and how they shall be determined.
Staff will present this text amendment with two other proposed changes to the Code of Ordinances related to bicycle and pedestrian safety in Town.

Recommendation(s): |
That the Council adopt the resolution calling for a legislative hearing to amend the Land Use Management Ordinance (LUMO) related to bicycle and pedestrian payments-in-lieu on April 6, 2022.
Key Issues:
• Currently there is no guidance in the LUMO related to determining and collecting payments-in-lieu for bicycle and pedestrian infrastructure.

A RESOLUTION CALLING A LEGISLATIVE HEARING TO CONSIDER A LAND USE MANAGEMENT ORDINANCE TEXT AMENDMENT PERTAINING TO SECTION 5.8.1 EXTERNAL CIRCULATION RELATED TO BICYCLE AND PEDESTRIAN PAYMENTS-IN-LIEU ON APRIL 6, 2022 (2022-03-09/R-3)
WHEREAS, the Planning Commission submitted a petition requesting information related to bicycle and pedestrian payments-in-lieu to allow them to make more informed decisions; and
WHEREAS, while compiling data related to the petition request Town staff found that Land Use Management Ordinance (LUMO) guidance pertaining to determining and collecting bicycle and pedestrian payments-in-lieu is lacking; and
WHEREAS, Town staff recommends formalizing the process for determining, collecting, and spending bicycle and pedestrian payments-in-lieu in the LUMO.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Legislative Hearing for April 6, 2022, at 7:00 p.m. to consider a Land Use Management Ordinance text amendment regarding bicycle and pedestrian payments-in-lieu.
