Approve Miscellaneous Budget Ordinance Amendments to Adjust Various FY 2017-18 Fund Budgets.

Overview: After the Council approves the annual budget, changes occur that require the Town to amend the original budget.

 

Recommendation(s):

That the Council:

                     Enact the attached budget ordinance amendment to adjust the General Fund, Capital Projects (CIP) Fund, Parking Fund, Transit Fund, and Transit Capital Reserve Fund; and

                     Enact the attached project ordinance amendment to adjust the Transit Capital Grants Fund and 2010 Public Buildings Bond Fund;

                     Adopt the attached resolution to amend the fee schedule for FY 2017-18; and

                     Adopt the attached resolutions to accept the GO Triangle Bus Grant and the FY 2018 NCDOT Section 5339 State Match Grant.

 

Key Issues:

                     General Fund

The Town has received the following payments in lieu of traffic signals and traffic studies between 2012 and 2017. 

 

          

During negotiations in the development review process, agreements are made between the developers and the Town regarding what payments in lieu are required for the project to be approved.  In order to recognize the revenue received by the developer and appropriate the expenditure, a budget amendment must be brought back to Council.   The Town also budgets funds annually in the General Fund for traffic signal and traffic study projects to address town-wide traffic flow needs.  For each of the projects above, the Town completed the traffic signal or traffic study using available operating funds rather than coming back to Council each time we collected a payment.  The purpose of this item is to recognize this revenue to be used for planned signal timings, construction of speed tables and crosswalks, and street light installation throughout various areas in the Town to replenish the operating budget.  Enactment of the attached budget ordinance amendment would recognize and appropriate the $83,000 from the General Fund fund balance for this purpose.

                     Capital Projects (CIP) Fund

The Town received $345 from the Sancar Turkish Culture Center as a payment in lieu of recreation and open space.  These funds will be combined with existing funding for the replacement of the Community Center Playground safety fall surface.  Enactment of the attached budget ordinance amendment would recognize and appropriate the payment in lieu of $345 in the Capital Projects Fund.

 

                     Parking Fund

The Town of Chapel Hill entered into a contract with 137 E. Franklin, LP for a sixty- month period beginning May 1, 2018 and ending May 1, 2023.  The Chapel Hill Police Department will manage the 285-space parking deck located at 125 E. Rosemary Street and shall lease spaces for monthly and hourly rental terms.  In order to begin charging for use of this lot, Council must adopt the attached resolution to amend the existing Police-Parking fee schedule.  The proposed fee schedule amendment establishes the 125 E. Rosemary Street Deck rates to be consistent with other downtown parking facilities owned or leased by the Town as indicated on the fee schedule to include any discounts, free parking periods or special events.

Enactment of the attached budget ordinance amendment would recognize $8,625 in revenue for monthly leased parking and $24,999 in revenue for hourly leased parking and would appropriate $17,840 to reimburse the Town for the cost of the 4 Parkeon pay stations and cameras purchased for the deck and $5,284 to be paid back to the lessor for their share of the revenue collected.

                     Transit Fund

FY 2015 FTA Section 5307 Grant - The Federal Transit Administration awarded the Town $18,133 in federal fiscal year 2015 Section 5307 grant funds for the purpose of continuing Chapel Hill Transit’s review of existing bus stops for compliance with the Americans with Disabilities Act.  The funds require a local match of $4,534, which will come from existing funding in the Transit Fund.  Enactment of the attached budget ordinance amendment would recognize and appropriate the grant budget of $22,667 in the Transit Fund.

                     Transit Capital Grants Fund

GO Triangle Bus Grant - In April 2017, The Research Triangle Regional Public Transportation Authority Board of Trustees approved the use of $2,290,000 from the Orange County Share of Triangle Transit Tax District revenues for the purpose of reimbursing the Town for the purchase of five buses.  The cost for each bus is $459,491 for a total of $2,297,455.  The difference between the total cost of the five buses and the grant award of $7,455 will come from the Transit Capital Reserve Fund. 

 

The Chapel Hill Transit Partners Committee also recommended using an additional $459,491 from the Transit Capital Reserve Fund for the purchase of one additional bus.  Adoption of the attached resolution and enactment of the attached project ordinance amendment would create the grant budget of $2,290,000, and would transfer $466,946 from the Transit Capital Reserve Fund for the purchase of an additional bus and to cover the bus purchase costs over the grant award

FY 2018 NCDOT Section 5339 State Match Grant - In March 2017, the North Carolina Department of Transportation awarded the Town $40,531 in matching funds to supplant the state grant that was awarded in FY 2017 but expired due to the project timeline (state grants only last for a one-year period).  This grant represents an increase of funds to offset a portion of the Town’s local match for its recent purchase of seven light transit vehicles (LTV), which were purchased using federal Section 5339 grant funds that were awarded in February 2015. 

 

The project is now complete and is ready to be drawn-down and closed out.  Adoption of the attached resolution would approve acceptance of the state grant.  Enactment of the attached project ordinance amendment would increase the grant budget by $400 for the purchase of the LTV vehicles with adjustments to the federal share of $319, state share of $21,121 and local share of ($21,040).

 

                     2010 Public Buildings Bond Fund

The 2010 Public Buildings Bonds are completed and a budget amendment is needed in order to close out the capital project.  The attached project ordinance amendment would recognize $43 in interest income to cover the costs of the completed project.

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the transit capital projects ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:

 

“SECTION I

 

Transit capital projects as authorized by the Town Council are capital projects funded from Federal Transit Administration (FTA) grants and grants from the State of North Carolina.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these transit capital projects within terms of funds appropriated here.

 

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are as follows:

Amounts appropriated for capital projects are as follows:

 

SECTION V

 

The Manager is directed to report annually on the financial status of the project in an informational section to be included in the Annual Budget, and shall keep the council informed of any unusual occurrences.

 

 

SECTION VI

 

Funds may be advanced from General funds for the purpose of making payments as due.  Reimbursement requests should be made to FTA in an orderly and timely manner.

 

 

SECTION VII

 

Copies of this amended projects ordinance shall be entered into the minutes of the Council and copies shall be filed within five days of adoption with the Manager, Business Management Director and Town Clerk.”

WHEREAS, the Research Triangle Regional Transportation Authority has made funds available for the Chapel Hill Transit Department; and

WHEREAS, the Research Triangle Regional Transportation Authority has awarded funds in the total amount of $2,290,000; and

WHEREAS, the funds would be used for the purchase of five clean diesel buses.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to accept the Research Triangle Regional Transportation Authority Funds and to make all necessary assurances.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to accept the North Carolina Department of Transportation Funds and to make all necessary assurances.
