Overview: The attached Memorandum of Understanding and Agreement proposes adjustments to the planned road improvements along High School Road associated with the approved special use permit modifications for the Chapel Hill High School (under construction) and the Schools’ Maintenance Building (not yet under construction).
Under the proposed Cost-Share Agreement, the approved bike lanes on both sides of High School Road would be eliminated. Instead, the Schools would construct an off-road combined bicycle-pedestrian pathway allowing the Schools substantial cost savings for the High School project underway and avoiding future expenses associated with the Maintenance Building project.
Based on changes to State Law enacted while the High School Special Use Permit Modification application was pending, the Agreement proposes that the costs of the revised improvements be shared by the Schools and the Town, as explained in more detail in the attached Technical Report.

Recommendations: |
That the Council approve the Memorandum of Understanding and Agreement to adjust the High School Road improvement plans and to share the costs of the road improvements; and,
That the Council enact the attached budget ordinance amendment to allocate funding up to $200,000 as the Town’s share of the bicycle/pedestrian improvements. The Town would also cover expenses associated with the SUP-stipulated bus shelter within this monetary limit.

• Does the Council approve of the change from an on-road bike lanes to an off-road combined bike-pedestrian path along High School Road?
• Does the Council approve of the sharing of the costs of these improvements?
Fiscal Impact/Resources: The attached ordinance would authorize Town funds, not to exceed $200,000, to reimburse the Schools for the off-road multi-use path and bus shelter.

A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING AND AGREEMENT FOR SHARING COSTS FOR IMPROVEMENTS TO HIGH SCHOOL ROAD IN CONJUNCTION WITH CHAPEL HILL-CARRBORO CITY SCHOOLS CHAPEL HILL HIGH SCHOOL REDEVELOPMENT AND MAINTENANCE BUILDING PROJECTS (2019-04-24/R-6)
WHEREAS, the Town Council has previously approved Special Use Permit Modifications for the redevelopment of the Chapel Hill High School and expansion of the Chapel Hill Schools Maintenance Facility on High School Road (the Permits); and
WHEREAS, the Permits call for certain road and transportation improvements to be made along High School Road and nearby intersections; and
WHEREAS, recent changes to State Law have clarified the roles and authority of the State and Town to require and pay for road and transportation improvements along State and municipal roads in conjunction with school development projects; and
WHEREAS, representatives of the Town and the Schools have met and negotiated proposed adjustments to the Permits in light of the changes in State Law; and
WHEREAS, the proposed adjustments have been incorporated into a Memorandum of Understanding and Agreement; and
WHEREAS, the Council finds that the proposed modification to the road improvements on High School Road and sharing of costs to be reasonable in light of the law and the benefits to the community at large resulting from the proposed off-road bicycle/pedestrian path.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council approves the proposed Memorandum of Understanding and Agreement between the Town and the Chapel Hill-Carrboro City Schools for the sharing of costs for improvements to High School Road as presented to the Town Council and authorizes the Town Manager to sign it on behalf of the Town, subject to any minor, non-substantive technical changes deemed needed by the Manager or Attorney.

BE IT ORDAINED by the Council of the Town of Chapel Hill that the Budget Ordinance entitled “An Ordinance Concerning Appropriations and the Raising of Revenue for the Fiscal Year Beginning July 1, 2018” as duly adopted on June 13, 2018, be and the same is hereby amended as follows:
