PROCEDURAL CONTEXT*

Land Use Management Ordinance (LUMO) 8.1 requires the Town Council, in its legislative capacity, consider proposed amendments to the LUMO or the zoning atlas.

BACKGROUND AND CONTEXT*

“Clean-Up” Initiative. Staff has identified several technical corrections needed for the Use Matrix. These errors include:

                     Previous amendments to the table have unintentionally eliminated a column from the Use Matrix, resulting in a misalignment between the uses and their corresponding zoning districts.

                     Previous amendments to the table have resulted in blank spaces and various other discrepancies that require rectification.

TRADEOFFS, ALTERNATIVES, IMPACTS

The LUMO currently acts as the primary zoning ordinance for development projects. If the Council rejects the proposed text amendments, the existing Use Matrix will remain in effect, potentially leading to developments being reviewed in unsuitable zoning districts due to misalignments. If adopted, the changes to the ordinance would be effective immediately, maintaining the integrity of the current LUMO Use Matrix until a new LUMO is implemented.

A RESOLUTION CALLING A LEGISLATIVE HEARING TO CONSIDER LAND USE MANAGEMENT ORDINANCE TEXT AMENDMENTS TO CORRECT ERRORS IN TABLE 3.7-1: USE MATRIX ON OCTOBER 9, 2024. (2024-09-25/R-4)

WHEREAS, the Council adopted previous text amendments, which unintentionally resulted in the removal of a column from the Use Matrix, causing a misalignment of some uses with their corresponding zoning districts; and

WHEREAS, staff has identified that previous text amendments to the Use Matrix have led to inconsistencies among uses; and

WHEREAS, staff is recommending a “clean up” of the Use Matrix to address technical corrections, reserving major changes for the LUMO Rewriting Our Rules project.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Legislative Hearing for consideration of Land Use Management Ordinance Text Amendments, to correct technical errors in Table 3.7-1: Use Matrix on October 9, 2024, at 6:00 p.m. in the Council Chamber, Town Hall, 405 Martin Luther King, Jr. Blvd.
