A RESOLUTION MAKING A RECOMMENDATION TO THE ORANGE COUNTY BOARD OF COMMISSIONERS REGARDING THE ETJ/JPA SEATS ON THE CHAPEL HILL BOARD OF ADJUSTMENT (2020-10-28/R-25)
WHEREAS, the Orange County Board of Commissioners has a resolution regarding the Orange County Appointment and Orientation Process for Boards and Commissions that specifies “… When a vacancy exists, the municipality will be requested to provide to the Board of County Commissioners a resolution with a recommendation for that vacancy;” and
WHEREAS, despite multiple recruitment efforts, the County has not received any applications from residents within Chapel Hill’s Extraterritorial Jurisdiction or within the Joint Planning Area. Per the Joint Planning Agreement, the positions may be filled with Town residents; and
WHEREAS, the Chapel Hill Board of Adjustment has reviewed the viable applications and made a recommendation to the Chapel Hill Town Council; and
WHEREAS, a Council Interview Committee for Semi-Autonomous Boards reviewed the viable applications and made a recommendation to the Chapel Hill Town Council.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council recommends the Orange County Board of Commissioners reappoint Thomas Wortman to the County Alternate ETJ/JPA position on the Chapel Hill Board of Adjustment.

RECOMMENDATION: The Board of Adjustment met on Thursday, October 1, 2020 and by a unanimous vote made the following recommendation(s) to the Town Council for consideration:
• Brian Godfrey, Reappointment, Town Resident
• Thomas Wortman, Reappointment, County/ETJ Alternate
• Geoffrey Green, Appointment Town Alternate
• Betty Sapp, Appointment, Town Alternate
SPECIAL REQUEST(s): The Board of Adjustment also requests that current serving members Nathan Boucher (Town Resident - Alternate) and Tony Hito (Town Resident - Alternate) be appointed to the vacant Town Resident Seats.
BACKGROUND: None.

RECOMMENDATION: The Council Committee: Board of Adjustment Interviews met on Wednesday, October 21, 2020 and by a unanimous vote made the following recommendation(s) to the Town Council for consideration:

• Thomas Wortman, Reappointment, County JPA/ETJ Alternate
• Geoffrey Green, Appointment Town Alternate
• Betty Sapp, Appointment, Town Alternate
SPECIAL REQUEST(s): No Comment
BACKGROUND: The Council Interview Committee supports the Board of Adjustment recommendation.
• Mr. Godfrey has served for one full term.
• Mr. Wortman has served since December 2019.
• Mr. Green is a 12-year Chapel Hill resident and works in City and Transportation Planning. His interests and experience in zoning, development, climate change, and racial equity issues align with Council goals and objectives.
• Ms. Sapp served for more than 10 years on the Board of Adjustment and the Planning Board of Pinehurst, NC. She received extensive training on the legal and ethical requirements for individuals serving on quasi-judicial boards and demonstrated a clear understanding of the responsibilities inherent in this role.

The Council will need to adopt a resolution to transmit a recommendation to the Orange County Board of Commissioners for consideration at its upcoming meeting for the County JPA/ETJ Alternate seat.
