Overview: Council has expressed interest in revisions to the Land Use Management Ordinance (LUMO) to add the 100-year 24-hour duration storm event to the stormwater requirements. The text amendment will address the peak flow rate requirements in LUMO Section 5.4 Stormwater Management.  

 

Recommendation(s):

That the Council adopt the resolution to call a legislative hearing to consider amending the Land Use Management Ordinance on March 20, 2024.

A RESOLUTION CALLING A LEGISLATIVE HEARING TO CONSIDER LAND USE MANAGEMENT ORDINANCE TEXT AMENDMENTS CLARIFYING THE STORMWATER WATER QUALITY VOLUME REQUIREMENT AND ADDING THE 100-YEAR 24-HOUR DURATION STORM EVENT TO THE PEAK FLOW RATE REQUIREMENTS IN SECTION 5.4 STORMWATER MANAGEMENT FOR MARCH 20, 2024 (2024-01-24/R-4)

 

WHEREAS, at the June 8, 2021 Council meeting, several Council members presented a petition to the Town Council requesting a comprehensive review of the Town’s stormwater management regulations; and

 

WHEREAS, there is concern that the regulations adopted in 2003 do not address the increased precipitation frequency and intensity being experienced because of climate change; and  

WHEREAS, the Town contracted with the team of Skidmore, Owings & Merrill and SRF Consulting Group (SRF) to conduct a review of the Town’s stormwater management regulations, including the areas of review listed in the Council members’ petition; and 

 

WHEREAS, the SRF report recommended adding the 100-year, 24-hour storm event to the peak runoff rate control design storms, and recommended clarifying the runoff volume that is to be treated to the 85 percent total suspended solids (TSS) removal requirements; and 

 

WHEREAS, the Booker Creek Working Group recommended adoption of the 100-year design storm to the peak flow rate requirements; and

 

WHEREAS, at the November 29, 2023 meeting, several Council members presented a petition to the Town Council requesting that the addition of the 100-year storm event be added to the regulations as soon as possible.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Legislative Hearing for consideration of Land Use Management Ordinance Text Amendments clarifying the stormwater water quality volume requirement and adding the 100-year 24-hour duration storm event to the peak flow rate requirements on Wednesday, March 20, 2024, at 6:00 p.m. in the Council Chamber, Town Hall, 405 Martin Luther King, Jr. Blvd.
