STAFF RECOMMENDATION

Staff recommends that Council adopt the resolution to designate Chief of Police or Assistant Chief of Police as signing officials on ABC Permit Applications.

LEGISLATIVE CONTEXT

State Statute G.S.18B-904(f) requires municipalities to notify the NC Alcohol Beverage Control Commission when changing or designating signing officials on ABC Permit Applications.

BACKGROUND AND CONTEXT

Currently, only the Chief of Police is the designated signing official for ABC Permit Applications at the police department. The ABC Commission allows signing officials to be designated by title and allows for additional signers with notification. This change would allow Assistant Chiefs of Police the ability to sign permits, in addition to the Chief of Police, providing faster processing of permits and increased convenience for community members.

A RESOLUTION TO DESIGNATE OFFICIALS TO MAKE RECOMMENDATIONS TO THE NORTH CAROLINA ALCOHOLIC BEVERAGE CONTROL COMMISSION ON ABC PERMIT APPLICATIONS (2024-11-13/R-3)

 

WHEREAS, G.S.18B-904(f) authorizes a governing body to designate an official, by name or by position, to make recommendations concerning the suitability of persons or locations for ABC permits; and

WHEREAS, the Town of Chapel Hill, County of Orange, wishes to notify the NC ABC Commission of its designation as required by G.S.18B-904(f).

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Chief of Police or Assistant Chief of Police, is hereby designated to notify the North Carolina Alcoholic Beverage Control Commission of the recommendations of the Town of Chapel Hill, County of Orange, regarding the suitability of persons and locations for ABC permits within its jurisdiction.
