STAFF RECOMMENDATION

Adopt the attached resolution awarding a bid and authorizing the Town Manager to execute a contract with the lowest responsive, responsible bidder, 5th Pocket Skateparks Inc., for $609,750.

Authorize the Town Manager to approve change orders as necessary, provided the contract cost remains within the budgeted amount.

ACTION/DECISION POINTS*

Council must adopt or reject the attached resolution awarding a bid and authorizing the Town Manager to execute a contract with the lowest responsive, responsible bidder. Staff recommends that the Council authorize the Town Manager to execute a contract with 5th Pocket Skateparks, for $609,750.

Council must authorize or deny the Town Manager's approval of change orders as necessary, provided the contract cost remains within the budgeted amount.

BACKGROUND AND CONTEXT*

                     Funding allocated with ARPA funding 2022

                     Commenced planning, design, and public engagement 2023

                     Staff presentation to the Parks, Greenways and Recreation Commission, Town Manager, and Council during the summer of 2024.

                     Partial funding allocated using 2025 Penny for Parks funding to cover construction cost increase. 

                     Project advertised for construction bids 5 separate occasions with the final time on October 30, 2024; Parks and Recreation staff also held an optional pre-bid meeting on November 4, 2024.

                     The Town received no bids the first four bidding opportunities and received one bid on November 8, 2024, and staff qualified 5th Pocket Skateparks Inc. as the lowest responsive bidder.

Parks and Recreation is recommending moving forward with 5th Pocket skateparks Inc. because they specialize in design consultation, construction management and skatepark construction.  Their unique designs encourage progression in all styles and skill levels of skateboarding without creating a dangerous environment for beginners.  5th Pocket has skateparks that they have constructed up and down the east coast.  In addition, they recently designed and constructed the new skatepark in Hillsborough, NC and come highly recommended by the Hillsborough staff.  Parks and Recreation staff have visited the new park in Hillsborough and were extremely impressed with the quality of work that 5th Pocket performed.

                     Staff anticipates that the contract will begin work in Summer of this 2025 and that construction will last 6-9 months.

FINANCIAL IMPACT

The project funding comes from ARPA funding and from the 2025 Penny for Parks funding.

COMMUNITY ENGAGEMENT

Staff from the Parks and Recreation Department worked with the town Marketing and Communications team staff to advertise through the town webpage, social media sites, project distribution list participants, signs, etc. and to promote opportunities to participate in community meetings and an online survey to receive input on the project need and proposed design of a new reconstructed concrete skatepark.

A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE A CONTRACT AND APPROVE CHANGE ORDERS WITH 5th POCKET SKATEPARKS INC FOR THE RECONSTRUCTION OF THE HOMESTEAD PARK SKATEPARK (2024-11-13/R-2)

WHEREAS, the Town of Chapel Hill solicited formal bids for the Homestead Park Skatepark Reconstruction Project on the Town website on five separate occasions and the fifth opportunity posted on October 30 2024 in accordance with N.C. General Statute Sec. 143-129; and

WHEREAS, the Town of Chapel Hill held pre-bid conferences on November 4, 2024; and

WHEREAS, one responsive bids was received and opened on November 8, 2024;

WHEREAS, the responsive bid was evaluated and 5th Pocket Skateparks Inc. was determined to be the lowest responsive, responsible bidder.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to execute a contract with the lowest responsive, responsible bidder, 5th Pocket Skateparks Inc. in an amount of $609,750.

BE IT FURTHER RESOLVED that the Town Manager is authorized to approve change orders as necessary provided that the contract cost remains within the budgeted amount.
