Overview: After the Council approves the annual budget, periodic changes require the Town Council to amend the current budget.

 

Recommendation(s):

That the Council:

                     Enact the attached budget ordinance amendment to adjust the Grants Fund, Transit Fund, and Library Gift Fund; and

                     Enact the attached project ordinance amendment to adjust the 2015 Streets and Sidewalks Bond Fund and the Transit Capital Grants Fund; and

                     Adopt the attached resolution to accept the Alcohol Beverage Control (ABC) Grant and Governor’s Highway Safety Grant.

 

Key Issues:

                     Grants Fund

Alcohol Beverage Control (ABC) Board Grant - The Orange County ABC Board awarded the Town of Chapel Hill $75,630 to continue supporting the Police Department’s alcohol law enforcement efforts.  These funds will be used for overtime salaries and special use funds for alcohol operations, equipment and supplies relating to those operations, and fuel and maintenance for the Town’s designated vehicle used during those operations. The grant award also includes $35,000 for the purchase of a new vehicle.  There are no matching requirements for this grant.  Adoption of the attached resolution authorizes acceptance of the ABC Grant, and enactment of the attached budget ordinance amendment establishes the grant budget of $75,630.

 

Triad Foundation Grant - The Triad Foundation awarded the Town of Chapel Hill Police Department a $175,000 grant. The grant funds will be used to purchase an advanced training simulator to improve officer decision-making, teach de-escalation techniques, ensure ongoing performance improvement, and promote accountability and transparency in policing.  Enactment of the attached budget ordinance amendment in the Grants Fund recognizes and appropriates the $175,000 grant from the Triad Foundation for the purchase of the advanced training simulator.

 

Department of Health & Human Services (DHHS) Grant - The Town of Chapel Hill Police Department is receiving funding from Orange County through a NC DHHS grant for Police and Mental Health Collaborations for Diversion Programs.  The purpose of this grant is to provide pre-arrest and post-arrest community diversion opportunities for individuals with serious mental illness who encounter the criminal justice system through law enforcement interactions.  The grant will fund a new social worker position for 2 years.  Enactment of the attached budget ordinance amendment recognizes and appropriates year 1 of the grant for $79,823 from Orange County for a social worker position.

 

Governor’s Highway Safety Program Grant - The Town received a grant from the Governor’s Highway Safety Program to continue the Town’s Vision Zero initiative. The funds are primarily for our part-time Complete Streets Specialist, a Vision Zero intern, and off-duty overtime for police officers to conduct high visibility crosswalk enforcement operations. The Town will hold public events and workshops to increase awareness of Vision Zero and identify small quick build projects around Town that will improve road safety.  Adopting the resolution authorizes acceptance of the Governor’s Highway Safety Grant and enacting the budget ordinance amendment establishes the grant budget for $102,600.

 

Safe Routes to School Grant - The Town received a Safe Routes to School grant from the North Carolina Department of Transportation (NCDOT).  This grant will be used to hire a full-time staff person to work primarily with the Chapel Hill elementary schools and CHCCS district to build Safe Routes to School programming and events for a two-year period.  In addition, funding will be used to hire a consultant to collect journey to school data and identify infrastructure gaps in safe routes to each school.  Enactment of the attached budget ordinance amendment recognizes and appropriates year 1 of the grant for $196,192, with a federal share of $156,954 and a local match of $39,238.

 

                     Library Gift Fund

FY 24 LSTA Grant (Driver’s License Program) - The Town has received a $29,200 grant from the State Library of NC for a project that will help adults with limited-English proficiency (LEP) apply for a driver’s license in NC. Chapel Hill Public Library staff, in collaboration with other Town Departments and members of the Refugee Community Partnership, will engage local immigrant and refugee community members to design, produce, & distribute a series of short videos & supplementary materials that outline driver’s license requirements, highlight resources, & provide tips to navigating the process of getting a license. The series will feature local community members speaking their preferred language. The finished products will be available for streaming or download via the library website and may be shared with other public libraries and community groups across N.C.  The total project budget is $32,700, with the $3,500 match coming from existing funds within the Library Gift Fund.  Enactment of the attached budget ordinance amendment recognizes and appropriates the $29,200 LSTA Grant for the driver’s license program.

 

FY24 LSTA Grant (Continuing Education) -The Town has received the Continuing Education Scholarship in the amount of $2,412 from the State Library of North Carolina to attend the American Association for State and Local History Conference. The AASLH Annual Conference is an in-person experience that engages and connects history professionals and volunteers and inspires them in their work. This year's theme, ("I, too, am America") is inspired by Langston Hughes’s 1926 poem “I, Too” where he stakes his claim on the evolving promise of an inclusive nation by stating “I, too, am America.” Conference sessions will range from best practices when working with marginalized communities to document and share their histories, to information on how other local history and memory workers are engaged in this work, to how community historians make their digital A/V collections publicly accessible without a dedicated budget.  Enactment of the attached budget ordinance amendment recognizes and appropriates the $2,412 LSTA Grant for the AASLH Conference.

 

NC Department of Environmental Quality (NCDEQ) Grant - In FY21, the Town received a reimbursable grant through NCDEQ for a “Zero Waste” project.  This project has been completed and the remaining funds need to be closed out.  Enactment of the attached budget ordinance amendment would un-recognize the remaining $508 budget for the grant and the corresponding expenditures.

 

                     2015 Streets & Sidewalks Bond Fund

Estes Drive Connectivity Project - On September 25, 2019, The Town was awarded $500,000 in federal STBG-DA funding for the Estes Dr. Connectivity Project.  Funding for the local match was identified on January 27, 2021 through a contribution from OWASA in the amount of $306,750 to improve a water main on Estes Dr. from Martin Luther King Jr. Blvd. to Caswell Rd. as part of the project.  On June 21, 2023, an amendment was brought to Council that reduced the contract to include actual bid numbers which will reduce the OWASA reimbursement by $148,441.  Since that time, the Town and OWASA have agreed on a final amount for the contract, which will increase the OWASA contribution by $75,960, bringing the contribution to $234,269.  Enactment of the attached project ordinance amendment to the 2015 Streets and Sidewalks Bond Fund increases the OWASA reimbursement by $75,960.

 

Estes Drive Bicycle & Pedestrian Improvements - The Town has received $163,971 in funding from the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization (DCHC MPO) through the North Carolina Department of Transportation (NCDOT) for nine additional months of funding to continue Construction, Engineering, and Inspections (CEI) services for the Estes Drive Bicycle and Pedestrian Improvement Project.  The funding from the MPO requires a 20% match in the amount of $40,993, which has already been allocated with the March 2023 Streets and Sidewalks bond issuance.  Enactment of the attached project ordinance amendment to the 2015 Streets and Sidewalks Bond Fund recognizes and allocates the $163,971 from NCDOT towards the Estes Drive Project.

 

Trinsic Residential Builders - On June 28, 2023, Trinsic Residential Builders reimbursed the Town $10,879 for installing a temporary gravel walkway along the Azalea Estates frontage.  This was required because Trinsic’s sewer installation for the Aura project delayed the Estes Drive Connectivity improvements and made that segment of Estes Drive impassable for pedestrians.  Enactment of the attached project ordinance amendment to the 2015 Streets and Sidewalks Bond Fund recognizes the $10,879 reimbursement and allocates those funds to the Estes Drive Project.

 

                     Transit Capital Grants Fund

Electric Buses - The Town of Chapel Hill was awarded $7 million in combined State and Federal funding for the purchase of 7 battery electric buses and associated charging infrastructure in 2021. $6,650,000 was dedicated to the buses and $350,000 was dedicated to charging infrastructure.  Due to rising costs in materials and changes in order pricing, total cost of the 7 electric buses is $7,953,356.  Chapel Hill Transit seeks to move $1,303,356 from Transit Fund Balance to offset the difference in cost. Chapel Hill Transit’s Funding Partners have approved of this allocation.  Enactment of the attached project ordinance amendment would transfer $1,303,356 from the Transit Fund towards the purchase of electric buses.

                     Federal Transit Authority (FTA) funding for light vehicles - The Town of Chapel Hill was awarded $244,653 in Federal funds (80% federal; 20% local match) for the purchase of three replacement Light Transit Vehicles (LTVs) for Chapel Hill Transit’s EZ Rider service. This grant requires a local match of $61,164 for a total award of $305,817. The local match is to be provided from the Transit Fund Balance. Chapel Hill Transit’s Funding Partners have approved of this project.  Enactment of the attached project ordinance amendment recognizes the FTA grant in the amount of $244,653 and transfer of $61,164 from the Transit fund and allocates $305,817 for the purchase of light vehicles.

                     Electric Buses - The Town of Chapel Hill was awarded a mixed State and Federal Grant Award totaling $5,300,000 for the purchase of five electric buses. The funding consists of $2,040,000 in Federal Funding from the State’s Congestion Mitigation and Air Quality (CMAQ) program, $668,000 in VW Settlement Money, $1,060,000 from the NC DOT’s Urban Match program, and $1,532,000 in local match funds. The local match is to be provided from the Transit Fund Balance. Chapel Hill Transit’s Funding Partners have approved of this project.  Enactment of the attached project ordinance amendment recognizes $2,040,000 in CMAQ funds, $668,000 in VW Settlement funds, $1,060,000 from NC DOT, and $1,532,000 from the Transit Fund and allocates $5,300,000 for the purchase of five electric buses.

                     NC DOT Advanced Technology Grant - The Town of Chapel Hill was awarded $200,000 (90% State, 10% Local) grant from NC DOT’s Advanced Technology Grant Program for the installation of on-board interactive media menus and displays on Chapel Hill Transit Buses. A $20,000 local match is required for this grant, while the remaining 90% is provided by the NC DOT. The local match is to be provided from the Transit Fund Balance. Chapel Hill Transit’s Funding Partners have approved of this project.  Enactment of the attached project ordinance amendment recognizes the $180,000 from NC DOT and $20,000 from the Transit Fund and allocates $200,000 towards the project.

WHEREAS, the Governor’s Highway Safety Program has made funds available for pedestrian safety initiatives for the Town of Chapel Hill; and

 

WHEREAS, the Governor’s Highway Safety Program has awarded a total amount of $102,600; and

 

WHEREAS, the funds would be used for a program support position, police overtime, and supplies relating to the project.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to accept the Governor’s Highway Safety Grant and to make all necessary assurances.

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the following capital project is hereby amended for Streets and Sidewalk Improvements funded from 2015 General Obligation bonds approved by the voters in November 2015:

 

“SECTION I

 

The capital projects as authorized by bond referenda approved in November 2015, and as determined by the Town Council, includes streets and sidewalks capital improvements extending beyond one year.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these projects within terms of funds appropriated here.

 

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:

Amounts appropriated for capital projects are hereby amended as follows:

BE IT ORDAINED by the Council of the Town of Chapel Hill that pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, that the transit capital projects ordinance for various capital projects funded from a variety of sources is hereby amended to read as follows:

 

“SECTION I

 

Transit capital projects as authorized by the Town Council are capital projects funded from Federal Transit Administration (FTA) grants and grants from the State of North Carolina.

 

 

SECTION II

 

The Manager of the Town of Chapel Hill is hereby directed to proceed with implementation of these transit capital projects within terms of funds appropriated here.

 

 

SECTION III

 

Revenues anticipated to be available to the Town to complete the project are hereby amended as follows:
